Does Alcohol and Spousal Abuse Qualify for Background Fails?

Loading

Unknown“Would-be Terrorists can buy guns, but can a reporter? NO.”

It was a sting; Neil Steinberg of the Chicago Sun Times was given an assignment to buy an AR 15, hopefully to prove how easy it is to acquire the bogeyman rifle that scares Liberals. Like most stings, there was an element of humor, not because the sting failed; no, it was Steinberg’s foolish attempt to salvage the article and prove to his readers that he wasn’t rejected because of alcohol and spousal abuse, but because he was a reporter. Like the sanctimonious drunk who is played for a fool and continues to deny a problem with alcohol during a drunken rant, Neil should have been advised to forget the story or to write it accurately without bias.

With a pious distaste for rifles and the people who buy them, Neil traveled to a source of evil, Maxon Shooter’s Supplies, in Des Plaines, IL, to buy an infamous AR 15.

Neil’s suspicions were confirmed, when he noticed a clerk’s dagger tattoo on a forearm. Neil asked a few questions about the ARs and the clerk asked Neil for his FOID card (Firearm Owner’s Identification Card). The rule was stressed: No card, No gun.

He decides to purchase the rifle and is passed on to Mike, who supposedly recognizes Neil’s name as a reporter (like Hemingway, famous writers find it difficult to escape their fame and an integral part of the story, for without this key, he would have no excuse and no story). With Neil’s cover blown, Mike has Neil fill out the required paperwork and Neil assumes he will pick up the rifle the next day, upon approval.

Sadly, later in the day, Neil was informed by Sarah of Maxon’s, that they could not sell him the rifle because he had failed the background check.

Neil was incredulous at the thought of being rejected by a gun store that hired men with dagger tattoos. He demanded to know why he was rejected.

Sarah replied that Maxon’s was not required to give out the reasons.

Undaunted, Neil was convinced that he was rejected because of his occupation.

Maxon’s was given an opportunity to respond to Neil’s allegations and they sent a lengthy response detailing Neil’s history of alcoholism and spousal abuse. Neil’s cover was blown more completely than he realized, but he was undeterred. Those were pathetic excuses not to sell him a rifle. Gun dealers preferred to sell to terrorists and crazy people, while rejecting upstanding drunks and wife beaters.

Too bad Mata isn’t here.

Unfortunately the laws strip you of your 2nd amendment right to own a firearm if convicted of spousal abuse, even if the incident was considered a misdemeanor crime.
https://www.justice.gov/usam/criminal-resource-manual-1117-restrictions-possession-firearms-individuals-convicted.
So yes the reporter should not have been sold a gun under this premise.
Seems he marked no on spousal abuse on the form and somewhere in conversation told the tatooed dude he had a conviction so his story was not adding up. After the Katie C. crap can you blame him?

I see CODE STINK(pink)is blaming the NRA for the orlando shooting never mind the fact the area was a Gun Free Zone and some of those got arrested in front of the NRA HQ in Fairfax Virginia Typical bunch of attention mongers looking for the cameras

In the case of spouse abuse, it’s the existence of certain circumstances that raise put a red flag on the background check database:

Qualifying Offenses: As enacted the statute defines “misdemeanor crime of domestic violence” (MCDV) as any state or federal misdemeanor that –

“has, as an element, the use or attempted use of physical force, or the threatened use of a deadly weapon, committed by a current or former spouse, parent, or guardian of the victim, by a person with whom the victim shares a child in common, by a person who is cohabiting with or has cohabited with the victim as a spouse, parent, or guardian, or by a person similarly situated to a spouse, parent, or guardian of the victim.”

If that describes you, you don’t get to buy a gun. You shouldn’t have been intimidating someone with threats of force or violence. You did have a 2nd Amendment right. Now you don’t. That’s how it works. Actions have consequences. Words threatening actions have consequences. If someone doesn’t understand that, it’s a good indication they’re not sufficiently responsible to be given a firearm.

https://www.law.cornell.edu/uscode/text/18/922 section D
No crazies, no druggies, addicts, liberals reporters most always have mental defect.

the use or attempted use of physical force, and you lose a right endowed by the creator, a right not an entitlement.
No infringement not hard to interpret is it? There are so many unconstitutional laws the left cant keep track of, nor enforce them. So lets pass some more for nothing more than political points and when they are broken, blame the NRA.

Indeed. All Constitutionally-guaranteed rights are in fact to some degree conditional. Restrictions properly arise to prevent someone from depriving others of their own rights to life, liberty, and the pursuit of happiness. Without that underlying understanding, the guarantees would become meaningless.

Alchaol has killed more people then guns but Codestink wont be protesting at any bay of tavern becuase the liberal leftists media scum would ignore them

@Greg:

In the case of spouse abuse, it’s the existence of certain circumstances that raise put a red flag on the background check database:

In the case of the reporter, he failed the background check. The system worked. Now, dear Greggie, explain to us how it is that (“Has a right to be radicalized” AG Lynch,) and DHS contracted security personnel Omar passed his background test. (Keep in mind that none of the most recent gun-control proposals by the ‘sitting on their ass’ Democrat cry-babies would have done a damn thing to stop Omar.)

There’s some intellectual egghead(David Cohen who c has called for the 2nd AMENDMENT to be Repealed I have a better idea why don’t they repeal this jerks american citizenship let him go live in France if he wants to

HAHAHAHAHAHAHAHAHAHAHAHAHAHAHAH — GASP1 *choke* (cough) HAHAHAHAHAHAHAHAHAHAHAHAHAHA!!!!!!!

@Ditto, #10:

Uh…what?

@Greg:

The reporter, he failed the background check. The system worked.

Attorney General Lynch stated that Omar “Had a right to be radicalized.”

Omar worked security for a DHS subcontractor where he passed and received a security clearance for the job.

Omar also passed his firearms back ground test.

None of the most recent gun-control proposals being pushed by the ‘sitting on their ass’ filibuster tantrum (it was in the news Greg,) Democrat cry-babies would have done a damn thing to stop Omar

Now, dear Greggie, explain to us (1) How it is that AG Lynch is defending his “right to be radicalized?” (2) How is it that Omar passed his DHS government contractor security check? (3) Why is it that the crybaby Democrats, who are having a group sleepover, didn’t put forth any legislation whatsoever that would have actually stopped Omar from qualifying for his government issued security clearance, or that would have disqualified him for serving as a government contracted security personnel, or that would have kept him from passing a firearms background check? Why is that Greggie?

Instead, these Pajama Club Democrats are pushing for gun control legislation that would have had no effect whatsoever in stopping the Orlando Massacre, while claiming that the reason they want their gun-control passed is because of the Orlando Massacre. Explain the logic Greg.

Typical liberal Fly on forehead kill fly with hammer beat out brains pea sized brains that is

Charlie “taxes… WHAT taxes?” Rangel states the civilians don’t need armed protection, but HE does. I am amazed at the stuff liberals let out of their mouths because they know the liberal media will cover for them.

@Ditto, #14:

Omar also passed his firearms back ground test.

What that should tell any intelligent person is that there might be something wrong with the screening process.

@Greg: 3 interviews with the FBI there is something wrong with the environment in the administration when it is known someone from his mosque turned him in and yet he kept all his certifications and blamed co-workers for islamaphobia. The psychiatrist that was named said there was no meeting, they lied about everything, they redacted even his 911 call to attempt cover up. Sit and try to justify why a simple federal charge and conviction on his record would have stopped this. Now they have lost track of his jihad bride what is that about?

@Greg:

What that should tell any intelligent person is that there might be something wrong with the screening process.

What ALL this should tell any intelligent person is: (1) The DHS own vetting process of security personnel hired by government contractors is seriously flawed. (2) The DHS can not even detect potential terrorists hired under the agency as security personnel and that there security clearance investigations process is just as flawed. (3) That AG Lynch supports the right of fanatical Islamists to be radicalized and that she is perfectly fine with them working for the government. (4) That the Pajama Democrats don’t want to even address the failures that enabled the Orlando Shooter, they simply want to use the terrorist attack and the dead as an excuse to pass ineffective gun-control laws that would not have stopped the shooter. (5) That Greggie doesn’t really care about stopping terrorists either, he just wants to make sure that his fellow citizens will not be able to protect themselves from mass murderers.

@Greg: Sure… that withholding information about terrorist inclinations because of the desire to protect, specifically, Muslims is a pretty stupid idea. Kind of difficult to exclude someone if the reasons for the exclusion is filtered out by the federal government.

@kitt, #18:

The NRA doesn’t like warning flags that interfere with firearm purchases to be slapped on people by bureaucrats, remember? Being on a no-fly list or a watch list shouldn’t earn you one. Neither should histories of domestic abuse, restraining orders, or alcoholism. Findings of mental incompetence shouldn’t result in a flag, either. I suppose we could flag all Muslims—that might meet with a lot of approval at the moment—but first you’d have to figure out how to identify them all as such and create a national database. That would be a big project—especially with the bureaucrats all busy hunting down and deporting 9 million undocumented Hispanics.

The guy wasn’t flagged because the law didn’t allow for him to be flagged. It isn’t because the FBI was somehow negligent.

Somebody recently made what I thought was an excellent suggestion: Require that all firearm owners carry liability insurance. The insurance industry lobby would quickly become a moderating factor. They like seeing lower risks.

@Skook: it should be convicted. Divorce often causes unfounded charges to be filed in spite and there is never a trial or conviction.

@Randy: It should be convicted but thats not the way the law was worded. It was passed like all unconstitutional laws as part of an omnibus crapload of legislature.

@Greg: He was a nut he should have been charged with harassment and stalking of a co-worker, a crime. With that crime he may have had a criminal record to reject him in the background check if the FBI wants to charge and convict, there are sooo many laws they could use. This animal needed tagging they failed to protect US citizens.

It’s easy to point out what seems obvious in retrospect, but the only useful flags are those that identify a risk ahead of time. There have to be specific criteria that are applied broadly enough to keep dangerous people from getting firearms, which don’t rely on the use of a crystal ball.

@Greg:
The guy wasn’t flagged because the law didn’t allow for him to be flagged. It isn’t because the FBI was somehow negligent.
How wonderfully ignorant of you.

They were negligent there were tons of things they could have charged him with and got a conviction, is hate speech only for white folks?
Is harassment only for white folks.
Is stalking a fellow co worker illegal?
He could have easily been flagged.
The NRA doesnt want criminals to have firearms, gives guns a bad name.
I found the Marshalls dept have quotas to maintain a good record they have to fill out suspicious flyers to be added to the gov watch lists.
http://www.thedenverchannel.com/news/marshals-innocent-people-placed-on-watch-list-to-meet-quota. How they get from watch to no fly is still secret.

@Greg:

The NRA doesn’t like warning flags that interfere with firearm purchases to be slapped on people by bureaucrats, remember? Being on a no-fly list or a watch list shouldn’t earn you one.

You know, I am beginning to believe you really don’t get this whole “Constitution” thing. Tell us, Greg, how does one get placed on a “list”? Is due process involved anywhere? If there is a process, is it anything like the effective and efficient way Mateen was deemed disqualified to get a weapon because he had terrorist ties, a violent nature and visited a radical Imam that encouraged violence? Is it administered by the same type of fascist personality that would use the IRS to attack someone simply because they are conservative?

Because, unless you can provide proof that there is a judicial process that evaluates threats without the interjection of politics or ideological influences, you need to find another instrument.

Meanwhile, if this administration had not directed the DOJ purge references to Muslims which, of course, is just about the ONLY information that applies to the terror threat that faces America, a scumbag like Mateen almost certainly would have been prevented from purchasing weapons and probably investigated further as to WHY he wanted the weapons. This would be like researchers trying to cure cancer but prohibiting themselves from looking at cells.

The guy wasn’t flagged because the law didn’t allow for him to be flagged. It isn’t because the FBI was somehow negligent.

No, the FBI was not negligent; they were hamstrung by this administration because of their demented and specific protection of Muslims. For them, the PC of our security is more important than anyone else’s lives. The agents TRYING to do their jobs cannot be faulted; in fact, some have complained about the investigative restrictions placed upon them.

It’s easy to point out what seems obvious in retrospect, but the only useful flags are those that identify a risk ahead of time.

You know what are “useful flags”? Someone having ties to a suicide bomber… someone that is a Muslim. Someone… that is Muslim… having a violent nature that goes off on violent rants about the US. Someone that travels to Saudi Arabia… that is Muslim. Someone whose Imam is a radical, violent hater and that, after he hears is first hateful, violence-promoting sermon… keeps going back. Those are some pretty valid flags.

This administration PURGED them. So, all you had left was a guy named Mateen who wanted to buy a gun.

@Skook: Undocumented?–Marxist? Get a grip Skook–you’re out on the fringe Marine

I think this incident shows there are plenty of laws on the books to stop illegal purchase of fire arms. People in general have no idea what they are in their state or federal laws are while clamoring for more.

I know many people who have had past convictions of alcohol related or “mis-steps as Hillary would say” in their youth who I am completely comfortable with gun ownership, but the law is the law. It would be a deterrent if people actually knew the law. Guns and hunting are big time things here.

Regarding spousal abuse, there is no messing around. I am a woman and lived in a a very rural area with one neighbor who threatened and harassed me, shot my windshield out of my car that was just a few feet from my house, and killed my animals. Law enforcement was often an hour away and would or could do nothing. They said it was my word against his. IF I had been Sleeping with him, they would have hauled him off to jail the first call I made to them. Isn’t that ironic?

Thank God for the Castle law. At least I would not lose the farm paying for a legal defense in case I did have to shoot him. End result, I sold the family farm to get away from him. I did keep 7 acres and am just waiting for him to die before I do anything with that. Of course he did not need to purchase any more guns, he has plenty.

@Songbird: Your word against his??? WTF–How did he claim your animals died? Your windshield?
Where the hell did you live?

@Richard Wheeler: I assume you have read Trotsky:

A means can be justified only by its end. But the end in its turn needs to be justified. (Also quoted as “The end may justify the means as long as there is something that justifies the end.”)

https://www.marxists.org/archive/trotsky/1938/morals/morals.htm

Although the concept was probably coined by Machiavelli, Trotsky justified Communist terror by the results. Harry Reid justifies lying to the entire country, (Romney hasn’t paid his taxes in 10 years, according to my imaginary friend). He justified the lie by the reelection of Obama. If you need his direct quotes, they are easier to find than those of Trotsky.

@Skookum: Obama was born in Hawaii and it is documented–for you to say otherwise casts doubt on other “proclamations” ” BHO IS A Marxist ETC
Harry Reid what relevance to BHO?

Fact More people were kiolled by drunk drivers then during the Vietnam war but hollyweed glorified drukiness and alcholism in crappy movies like SIDEWAYS

@Richard Wheeler: West Virginia. It’s all true. The county sheriff’s office told me that. I did not have grounds for a restraining order. His word against mine on anything he did. The State police coud not get to involved in another jurisdiction on this kind of problem! Messed up situation and corrupt small town justice, too damn lazy to do their jobs. Possibly I might have received better treatment I were related to an officer or local politicians.

There were no other neighbors to hear, even down the road they knew he was a psycho asshole. The State Police did investigate the bullet in the front windshield but it could not be found. Besides that gun was long gone if they did find it. He shot my dogs on my property by the house. He threatened to kill my horses. The list goes on and on. He would use a high powered rifle with a scope from the woods (mine).This is why I get so ANGRY when idiots who live in the city want to take our guns away. I thank God He got me out of there.

And I can honestly say I never met another person like him in all the years I lived there. The people are wonderful. Neighbors help one another. That’s why I was so shocked by all of it.

I guess I can also say my asshole neighbor would not be on any list. Haha Unless he was arrested recently. So I just contradicted myself a little.

@Richard Wheeler: Rich, is it necessary to document Obama’s lies? It is his undocumented college transcripts that I am referring to. There have been very few scholars who hid their college transcripts because they were too impressive, but if that is the case Obama would have avoided controversy and mistrust by letting America in on his academic achievements.

Could you have applied to OCS with sealed transcripts?

I am not referring a birth certificate; there is a significant amount of data required to become an officer and a gentleman. A birth certificate is probably the first document. It gets a lot tougher after that, but when you have everything sealed, the boards would laugh at you before they give you the bum’s rush.

@Songbird: West Virginia That explains it —Think “Deliverance”:

@Skookum: Do you question his being Prez. of Harvard Law Review? Do you think that could have happened had he not graduated from Columbia without AT LEAST gentleman “Cs”? equivalent to what my frat brother W got at Yale
You’re an intelligent guy. Do you question Obama’s basic ntelligence? I certainly don’t..

Do you think Trunp should release his tax returns? Don’t you think all vetted potential Veeps will be asked to do so?

@Richard Wheeler: West Virginia That explains it —Think “Deliverance”: Lumping all from that state, shame
There are assholes everywhere, How do you think the people in Baltimore and Ferguson feel about their home values after the BLM crap that went down?

@Richard Wheeler:

Do you question his being Prez. of Harvard Law Review?

Unlike Ted Cruz, Obama never DID anything as President…. of the Harvard Law Review (a portent of things to come). He probably got appointed due to being light skinned with no Negro dialect, unless he wanted to have one.

Do you question Obama’s basic ntelligence?

He apparently has no idea how to apply whatever knowledge he has.

@Richard Wheeler: Rich, you are exposing symptoms of masochism.

On November 16, Harvard Law Review President, Barack Obama, wrote a letter to Mr, Chen for inclusion in the Harvard Law Review. His purpose was to justify Affirmative Action in the selection process of the Harvard Law Review.

If you read the letter, you will observe multiple errors in syntax and grammar. With the first sentence, notice that the subject and predicate don’t agree. The mistakes continue throughout the letter.

Here is the last paragraph:

“I would therefore agree with the suggestion that in the future, our concern in this area ia [sic] most appropriately directed at any employer who would even insinuate that someone with Mr. Chen’s extraordinary record of academic success might be somehow unqualified for work in a corporate law firm, or that such success might be somehow undeserved. Such attributes speak less to the merits or problems of affirmative action policies, and more to the tragically deep-rooted ignorance and bias that exists in the legal community and our society at large.”

The condescension and patronizing tone is obvious; however, if you are intent on insulting someone’s intelligence, it’s best to write without sophomoric mistakes. Otherwise, readers will assume the selection process for the Harvard Law Review is similar to the Nobel Peace Prize.

Now, remember, the letter was written by a graduate student, but if you read the letter objectively, you know it would receive a failing grade in a freshman composition class. This letter is one of the reasons why many of us are suspicious of sealed academic records.

There is more.

@kittThink I’m bad?: Ck out Bill’s #42 “light skinned with no Negro dialect.” Jeez.

@Richard Wheeler: @Ditto: I had that in quotes, originally, but had the idea to try and reel in a liberal always on the hunt for something to link to racism. It is, in fact, a combination of Biden’s and Reid’s description of Obama. Nice to know that all that matters is who allegedly says it.

@Richard Wheeler: I regret I named the state. I am just honest when asked a question. My point was rural areas need guns for their own protection and city people don’t have a clue. There were 2 State Po!ice to cover 2 counties.

Of course WV is nothing like “Deliverance”. Many northern people immediately subtract 10 or 20 points from a southern person’s I.Q. In fact comparing West Virginia to “Deliverance” (fiction) is a very biggoted thing to do.

@kitt: My ordeal and finding how small town corruption operates only illuminated me that corruption obviously exists in big cities and the Federal government. Unless you are in the “elite”, the rich and powerful in a city, the average person does not believe it exists or doubts the extent of corruption.

” There are no secrets in a small town.” Your kids know who deals the drugs that local police never arrest. The dealer’s are paid off. You know the person you sit by in church is the D.A. who only prosecutes those not in the elite group. Those that he snorts pills with or contribute to his campaign are never prosecuted. His brother, the local pediatrician, passed out in his office from chugging cough medicine. He still practices. People in the city are ignorant or choose to remain silent.

Look how long Bill and Hillary’s dirty deeds came to light!

@Songbird: I am sorry you had a neighbor like that. Not all rural cops are like that, my Son-in law had a neighbor that was letting down a fence and allowing his cattle into his food plots, he spoke to him thought it was settled but the situation kept repeating so he called the sheriff, the sheriff said he would have been eating beef, not venison, then advised the neighbor for every cow caught on a game cam it would be a 300 dollar fine even if its the same cow twice the matter was settled.
Rich the excuse of Bill did it first…really? If Bill jumped off a bridge….

@Bill: I hope this comment fits in this discussion of Obama’s intelligence. I don’t comment here often enough to follow the personal accusations, “stuff”. I have always wondered about Obama’s way of speaking, vernacular. I estimate it is about a 6th grade level, maybe lower. Is it a strategy to relate to the formally uneducated or is he really that dumb? His foreign policy is “don’t do stupid stuff.” I think he is a brilliant sociopath. Bad grammar is a well practiced strategy. I can’t imagine a Harvard graduate, the President of the United States speaking this way. No one has ever called him out. The press would not dare. Hillary always tailors her accent and lies to her location. The press is just now catching on?
