US attorney recommends proceeding with charges against McCabe, as DOJ rejects last-ditch appeal

U.S. Attorney Jessie Liu has recommended moving forward with charges against Andrew McCabe, Fox News has learned, as the Justice Department rejects a last-ditch appeal from the former top FBI official.

McCabe — the former deputy and acting director of the FBI — appealed the decision of the U.S. attorney for Washington all the way up to Jeffrey Rosen, the deputy attorney general, but he rejected that request, according to a person familiar with the situation.

The potential charges relate to DOJ inspector general findings against him regarding misleading statements concerning a Hillary Clinton-related investigation.

A source close to McCabe’s legal team said they received an email from the Department of Justice which said, “The Department rejected your appeal of the United States Attorney’s Office’s decision in this matter. Any further inquiries should be directed to the United States Attorney’s Office.”

McCabe, who recently was hired as a paid CNN commentator, spent 21 years with the FBI. He became the acting director in May 2017 after President Trump fired former director James Comey.

Last month, a source close to the process told Fox News that McCabe had a “target on his back” because of the Justice Department inspector general findings.

Then-Attorney General Jeff Sessions fired McCabe in March 2018 after the inspector general found he had repeatedly misstated his involvement in a leak to The Wall Street Journal regarding an FBI investigation into the Clinton Foundation.

Jessie Liu is a Trump appointee who worked on his transition team, and is now working under a DoJ Director who is also a Trump appointee and has suppressed the results of the Mueller investigation, denied Congress access to witnesses and the underlying evidence, and has propped up Stevie Mnuchin’s compliance with orders that he break the law to deny Congress access to Trump’s tax returns.

Giving her the benefit of the doubt, she might have “succumbed” to pressure to prosecute McCabe in order to move the entire situation into a courtroom where in will be put directly in the public spotlight during the lead-up to the 2020 election. (Deep State Conspirators are everywhere!) It would be a very clever move, protecting herself from career-destroying retaliation while giving Trump sufficient rope with which to politically hang himself.

Personally, I hope the next president gives McCabe and Comey medals.

@Greg: I seriously doubt a dirty cop that leaks classified materials will see any medals.
But if he knows to much he might just be on the suicide watch list. He might get Jeffie’s old cell.
Has suppressed the results of the Mueller investigation by releasing the entire political hit piece findings with minimal redactions.

@Greg: I do not think the Judicial Department is through with McCabe. They have not even started with the fraud he concocted to the FISA court. Flynn is very likely to sue McCabe and his pals to regain his life savings that he spent on legal fees due to McCabe lies. What is McCabe had come after you Greg? So, what the HELL does any of that have to do with the OIG’s findings? Not long ago, you were totally comfortable and confident in having avowed and avid Trump-hating, Hillary-loving ideologues investigating and prosecuting Trump and anyone he has ever known. NOW association is a problem?

Personally, I hope the next president gives McCabe and Comey medals.

Yeah, something on the pattern of “Hero of the Soviet Union”. An award for attacking the Constitution and the nation. Maybe “National Scumbag Award”?

Nail McCabe’s nuts to the wall. He gives every indication he is afraid of prosecution. Give him the General Flynn treatment. Show him his vulnerability (no doubt he lied) and press him with everything we have. Threaten and intimidate him, bankrupt him. Then let’s see how he sings. My guess is he’ll drop dime on the whole unholy operation.

They’ll need a change of venue.
DC and parts of VA went overwhelmingly for Obama and Hillary.
In such venues we’ve seen jury nullification in CA twice recently:
1. In the case of the fatal shooting of Kate Steinle NO ONE was found to have caused her death!
Even when a car comes out of gear and kills a person, the driver can and is found guilty of INvoluntary manslaughter! But Kate’s killer was not even found guilty of anything!
2. In the Antifa bike lock attack that caused grievous bodily harm to an innocent person, the attacker was disguised but modern technology proved who he was under the mask. Then the attacker was identified by bystanders and fellow Antifa demonstrators as well as his own social media admissions. Still the jury let him walk.

Change the Venue or don’t bother.

But back to those that have been caught the FBI, CIA, DNC we will wait to see if they ever see the justice the deserve.

Civil court may be the only area where some form of justice will be served. Until there are actual indictments, convictions, and jail terms, this is all wishful thinking on the part of the “tick-tock” crowd. The Department of Corruption, excuse me Justice, has a long way to go in proving they are not trying to cover for these seditious bastards. Ditto for the Federal Bureau of Corruption, excuse me Investigation.
