In a new twist, a U.S. District Court judge has ordered special counsel Robert Mueller to hand over all secret documents related to the questioning of former National Security Adviser Michael Flynn.
Flynn’s legal team claims the Federal Bureau of Investigation urged the retired United States Army lieutenant general not to bring a lawyer to an interview with agents at the White House in January 2017. Flynn has since pleaded guilty to one count of lying to prosecutors and is scheduled to be sentenced on Tuesday.
U.S. District Judge Emmet G. Sullivan on Wednesday ordered Mueller to turn over all documents and “memoranda” related to Flynn’s questioning by 3 p.m. Friday. Sullivan is the same judge who overturned a 2008 conviction of former Sen. Ted Stevens after government misconduct was revealed.
Former FBI Deputy Director Andrew McCabe set up the White House interview with Flynn, suggesting he not have a lawyer present. “I explained that I thought the quickest way to get this done was to have a conversation between [Flynn] and the agents only,” McCabe wrote, according to newly filed court documents.
“I further stated that if LTG Flynn wished to include anyone else in the meeting, like the White House counsel for instance, that I would need to involve the Department of Justice. [Flynn] stated that this would not be necessary and agreed to meet with the agents without any additional participants.”
FBI officials also decided not to warn Flynn that he could face perjury charges if he made false statements during what appeared to be an informal interview.
Note to Mueller: Stick to the NY Southern district or go to the 9th District if you don’t want your fascist tactics questioned.

The court likely will reject it, but the court probably wasn’t the target audience for the entrapment spin. Consider that making such a claim at this point—after Flynn has pleaded guilty, and after the prosecution has recommended a minimal sentence—doesn’t really serve General Flynn’s own personal interests. In fact, it’s a decidedly boneheaded play.

No, Mueller wants Gen. Flynn to fade away into the darkness. How the General was treated and what Mueller got out of it is an embarrassment. I hope the Judge demands an explanation as to why so much reliance was put on a 302 cobbled together 7 months later… or what happened to the original.
Basically, we are left with Mueller’s word that Gen. Flynn lied. Penning a description of the interview 7 months later is a travesty. Gen. Flynn should be cleared immediately and Mueller indicted for obstruction of justice.
Flynn pleaded guilty to lying, in a courtroom, before a judge. This was done under oath. What do you not understand about this?

Gen. Flynn provided nothing against Trump; why recommend leniency for a “liar”? The persecution of the General is turning into a massive liability. I hope the General cleans Mueller out.
One thing I understand is that Donald Trump would totally destroy faith in our nation’s legal system, if that’s what it took to protect Donald Trump.
He’s following the same methodology the FBI uses to bring down any powerful criminal organization.
@Greg: Obama destroyed the faith and confidence of blind justice in America. He turned the DOJ and FBI into muscle for the Democrat party. It is crystal clear that there is NOTHING but lies shoring up this “investigation”.
I don’t think they ever had to lie, falsify evidence and suppress facts to convict real criminals. Garbage like Mueller only have to do that when they have a mission to destroy someone but don’t have the evidence to do it.
@Greg: Wrong 302s need to be filed within 5 days that is protocol policy and procedure. They are following the decade old Stevens path of political chicanery.
A coerced confession is a violation of Flynns 5th amendment rights and a judge can toss it out.
@kitt: This is probably just one of the reasons Mueller is trying to quietly bury the Gen. Flynn case. Beyond any doubt, this is a sleazy operation.

The 302 written months later may not consist of notes about the earlier interview with Flynn recorded by the agents. It appears instead to relate to a much later interview of the agents themselves.

@Greg: So, where is the 302 filed, as required, within 5 days of the interview? This seems to imply THIS 302 is for an interview of the interviewers. It still amounts to the 302 being written 7 months late.
@Deplorable Me: Being the inquisition was with such a high profile person you would think these procedures would be followed to the letter with all eyes dotted and tees crossed. Seems the eyes were crossed and they might have been dotted after a 2 hour lunch.

General Flynn plead guilty because he was financially waterboarded and his family was threatened with more financial woes.
The government can outspend just about anyone and when they turn those screws, how can anyone afford not to give in?

@Greg: No, no surprise. Mueller is stalling while he tries to figure out how he is going to tell the useful idiots that there is no Trump collusion, there never was and there never will be any. Probably also making sure all the evidence collected about Hillary and Uranium One, the collusion with Russians by Obama, Hillary and the DNC, the seditious coup gets effectively destroyed.
Yeah, no surprise. There will then be another delay, then another, then another… right up till the 2020 election. But, take note: it’s wearing thin. People are growing weary of the obvious bullshit and lies. Only liberals are dumb enough to swallow it.

In the end, it was revealed that Plame was NOT covered under the protections for undercover agents (she had timed out) and that it was really Richard Armitage who had outed Plame to Novak? In the end, all that was done was the railroading of Scooter Libby, ala Flynn.
