Biden’s DOJ has indicted Donald Trump for the third time, but this one is different. Jack Smith has brought an indictment against Donald Trump that criminalizes free speech. The counts:

  • Conspiracy to defraud the United States
  • Conspiracy to obstruct an official proceeding
  • Obstruction of and attempt to obstruct an official proceeding
  • Conspiracy against rights.

Professor Jonathan Turley described it this way:

George Washington University law professor Jonathan Turley said Smith issued “the first criminal indictment of alleged disinformation.” “If you take a red pen to all of the material presumptively protected by the First Amendment, you can reduce much of the indictment to haiku,” he said. “I felt that the Mar-a-Lago indictment was strong. This is the inverse.”

Andy McCarthy:

Former New York federal prosecutor Andy McCarthy said Smith had to stretch the statutes to capture Trump’s behavior. “[Smith] has extravagantly stretched these statues in order to try and capture this behavior and that’s because this is a proxy for what should have been a political impeachment process they’re leaving to the criminal justice system, the failure of Congress to carry out a successful impeachment,” McCarthy said.

The timing of each of the Smith indictments is very curious

None of that matters. Despite his mixed record Smith is going to prevail.

  2. Because of lunatic U.S. District Judge Tanya Chutkan.

Chutkan was born in Jamaica and graduated from the University of Pennsylvania’s law school. She is married to former DC Superior Court Judge Peter Krauthamer.

Her resume includes a previous job likely to attract significant attention from Trump allies. She worked at the law firm Boies Schiller Flexner from 2002 until she was confirmed as a federal judge in 2014, according to a biography she submitted to the Senate Judiciary Committee.

Boies Schiller has strong connections to the Democratic Party, and then-second son Hunter Biden — whose dad, President Biden, is likely to face Trump in the 2024 election — was of counsel at the firm from 2009 to 2014, according to OpenSecrets.

She over-punishes right wingers, especially those from Jan 6

“Chutkan has handed out tougher sentences than the [Justice Department] was seeking in seven cases, matched its requests in four others and sent all 11 riot defendants who have come before her behind bars,” the AP wrote in a profile article last year.

“In the four cases in which prosecutors did not seek jail time, Chutkan gave terms ranging from 14 days to 45 days.”

She, like Smith, is a rabid partisan hack. The evidence won’t matter. Justice won’t matter. The Constitution won’t matter. Motions to change venue will be denied. Trump is not well liked in DC. The jury will be fixed.

Trump will be convicted in this case. Chutkan is highly likely to sentence Trump to decades in prison adn taken into immediate custody. He will likely lose his appeal to the DC Circuit. But the news isn’t all bad. The Supreme Court will see through this garbage and certainly overturn the case. But the point of the whole exercise is to keep Trump out of the race. The first two indictments are sufficiently complicated, and one superseded the other, which would probably push them past election day 2024.

That’s why the trial date in this case is so critical. Trump could well find himself in jail before election. Chutkan will not free him on bail pending appeal.

It’s an interesting time when the current corrupt President is having his corrupt DOJ attempt to imprison not only a former President but his likely Presidential election opponent. If they manage to get Trump, their guns will be turned on DeSantis. That’s the kind of country in which we find ourselves today. This will become the template for how the democrat-controlled government works. As I’ve written, the goal is a one party state forever.

This indictment, as the others, could have been brought two years ago. You can ask yourself why they weren’t.

The indictment has NOTHING to do with free speech. It’s about an orchestrated conspiracy to overturn an election by illegal means. There was nothing spontaneous about any of it. It was a complex multi-part plan that failed disastrously on January 6.

The New Charges Against Trump Carry the Death Penalty

From the beginning, the Biden regime has wanted to render Donald Trump politically dead. Now they’ve opened the possibility of death of a more physical variety. With their latest kangaroo court charges, their bête noire now faces the death penalty. Yes, that’s right: drug dealers, murderers, and rapists walk free in blue cities all the time, but a former president and current presidential candidate who dares to stand up to the political and media elites could now get the big sleep.

It has been clear from the beginning that the indictments of Donald Trump are brazenly political, designed to discredit the Biden regime’s principal political opponent to the extent that he either cannot run again in 2024 or is so tainted in the eyes of the American people that it doesn’t matter whether he runs or not. A principal part of this strategy has been to exaggerate misdemeanor charges into felonies and split what would in ordinary circumstances have been one charge into many, such that Trump has now been charged with no fewer than seventy-eight felonies that could get him hundreds of years in prison. Or even, now, execution.

Breitbart reported Tuesday that “Special Counsel Jack Smith’s indictment Tuesday against former President Donald Trump for his role in attempting to challenge the results of the 2020 presidential election includes several weighty felonies, including one for which death may be a penalty.”

That one would be 18 U.S.C § 241, “Conspiracy Against Rights,” one of the most absurd aspects of this entire ridiculous indictment. The Washington Post explains that this statute was “originally adopted as part of the Enforcement Act of 1870. It was the first in a series of measures known as the Ku Klux Klan Acts designed to protect rights guaranteed by the 13th, 14th and 15th amendments, collectively called the Reconstruction Amendments.” Why is Trump being charged under an anti-KKK law? Well, because he is America’s number one racist in the eyes of the Left, of course, so as far as Smith and his henchmen are concerned, the optics are good here. The idea is that Trump somehow hindered people’s right to vote by contesting the veracity of the 2020 election. No, it doesn’t make any sense to me, either.

This law was clearly designed to go after Klansmen who acted to prevent free black men from exercising the right to vote during the Reconstruction era. It calls for fines or up to ten years in prison “if two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same.” It calls for the same penalties “if two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured.”

What’s that? Did they catch a masked Trump out on I-95, preventing cars full of pious people of color from proceeding on their way to the polling place? As crazy as this charge is, it gets even crazier in light of this clause: “If death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.”

Breitbart points out that there has indeed been a death that has resulted from all this: “One person — Ashli Babbitt, a rioter shot by a law enforcement officer — died as a result of the Capitol riot on January 6, which Smith said Tuesday was the result of Trump’s claims about the election.” What’s more, “Democrats have blamed Trump for the unrelated deaths of several protesters and Capitol Police officers.”

That means that if they make this charge stick — and given the desperately corrupt and politicized nature of Merrick Garland’s “Justice” Department and the entire Beltway political establishment, they very well may do so — we may be watching footage of Trump enjoying one last Big Mac and fries in his cell before he is led down the hallway to be strapped into Old Sparky.

Inconceivable? I wish it were. But we’re deep into banana republic territory with this criminal regime now, and so nothing can be ruled out.

Article I, Section 3, Clause 7 of the Constitution states, “Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.”
President Trump was NOT CONVICTED in the 2021 Senate trial; therefore he is not liable and subject to Indictment, Trial, Judgment or Punishment. He is indemnified from any further legal action. It is time to end this bipartisan effort to prevent President Trump from returning to office.

Therefore anything related to January 6 in terms of an indictment is unconstitutional, full stop.

When republicans blocked Trump’s removal from office and then his disqualification from reelection, they rationalized by saying a future courtroom was the proper venue. The future is now, and here we are. They could have spared themselves and the country the trauma, but they didn’t.

This is not a matter of impeachment. It’s a matter of criminal law. Trump lost presidential immunity from criminal prosecution the moment he left office.

Maybe he really could shoot a man on Fifth Avenue and not lose any voters, but that doesn’t mean he wouldn’t be arrested and charged.

We the people want President Trump back in the WH. The establishment does not want the people to vote in a candidate if they’re choosing. That by definition is not a constitutional republic.

It isn’t about “criminalizing dissent”. It’s about specific criminal acts that were deliberately undertaken as part of an organized plot to remain in office.

It makes absolutely no difference whether Trump “knew” he’d lost the election. Like every American, he’s allowed to have wrong opinions, to exaggerate, even to lie about what he thinks. The indictment isn’t about that. It’s about criminalizing dissent.

In the case of the DC circuit, chief justice Roberts oversees the court. Roberts has been a disappointment from a conservative perspective but this is uncharted territory.
Should the court decide not to take this up it will further the declining confidence Americans have in the institutions of government.

Don’t disregard the possibility of the DC court simply forbidding the exculpatory evidence, as they repeatedly did in every January 6th trial. Of course it won’t hold up, but the primary goal is to knock Trump out of the race. Conviction and prison would just be icing on the cake.

The pedocrats in the house of representatives are already pushing for televised proceedings. If there was any intention to have a fair trial wherein real evidence was presented and there was any hope of justice being served, they would not be so quick to want this. This will be a soviet style show trial on par with the sham proceedings that levied almost a billion dollars of fines and restitution on Alex Jones. Lavrentiy Beria would be proud, no doubt. That said, is Jack “hack job” Smith’s hesitant, almost fearful demeanor a tell that he knows that he himself could eventually be charged and convicted of election interference for his involvement in Trump’s persecution?
