Looks like the Supreme Court will conference on the Obama citizenship lawsuit:
A case that challenges President-elect Barack Obama’s name on the 2008 election ballot citing questions over his citizenship has been scheduled for a “conference” at the U.S. Supreme Court.
Conferences are private meetings of the justices at which they review cases and decide which ones to accept for formal review. This case is set for a conference Dec. 5, just 10 days before the Electoral College is scheduled to meet to make formal the election of Obama as the nation’s next president.
The Supreme Court’s website listed the date for the case brought by Leo C. Donofrio against Nina Wells, the secretary of state in New Jersey, over not only Obama’s name on the 2008 election ballot but those of two others, Sen. John McCain and Roger Calero.
The case, unsuccessful at the state level, had been submitted to Justice David Souter, who rejected it. The case then was resubmitted to Justice Clarence Thomas. The next line on the court’s docket says: “DISTRIBUTED for Conference of December 5, 2008.”
If four of the nine justices vote to hear the case in full, oral argument may be scheduled.
The action questions whether any of the three candidates is qualified under the U.S. Constitution’s requirement that a president be a “natural-born citizen.”
The rest of the article goes on to detail the fact that the FEC has waived its right to respond to the Berg complaint:
“There are a number of reasons why the respondents here would choose not to respond. First, because the court only grants between 70 and 120 of the 8,000 or so petitions it receives every year, perhaps they just liked their odds of Berg’s petition getting denied. Second, because they have made arguments as to Berg’s lack of standing several times at the district court level and beyond, perhaps they felt as though any arguments had already been made and were available on the record. Or, perhaps the waiver shows that the FEC and other respondents do not take seriously the allegations put forth by Berg, and did not wish to legitimize the claims with a response,” the blogger speculated.
“Another thing which is not completely clear is whether the FEC is filing for itself or on behalf of all respondents,” he added.
“If it were just the FEC filing the waiver, I must say that I’m surprised,” Berg told America’s Right. “I’m surprised because I think they should take the position that the Supreme Court should grant standing to us. I think they have a responsibility not only to Phil Berg, but to all citizens of this country, to put forth a sense of balance which otherwise doesn’t seem to exist.
“However, if this was filed by the FEC on behalf of the DNC and Barack Obama too, it reeks of collusion,” he said, noting that the attorney from the solicitor general’s office should be representing federal respondents and not the DNC or Obama.

This means that, in the end, someone will have to define the founding fathers’ intent vis-à-vis the “natural born citizen” requirement. Did they require a pure pedigree? — or would they accept split loyalties in the executive office? The answer to this question strikes me as a no-brainer. My brain notwithstanding, however, the question must be answered at a constitutional level — the Supremes must define “natural born citizenship” and they must apply their definition to the Constitutional requirement. In short, Obama’s in a world of hurt, which explains why this Harvard-trained Constitutional attorney has consistently ducked the issue. Once he produces a birth certificate, he will be compelled to answer all the other questions, and there is no satisfactory answer that won’t demonstrate his dual loyalties.
Consider, for example, that less than one year ago Obama campaigned for his cousin Odinga in Kenya. Most Americans understand that an American senator campaigning in Kenya for a Communist who pledged to institute Sharia Law was problematic. This matter becomes even more complex when you remember that the same American senator is a “natural born citizen” of Kenya — it just looks funny. And now he wants to be president.

I can’t believe this issue has taken this long to begin coming to the forefront. It seems to me that a fair policy for any candidate who wishes to be on the ballot would be for that candidate to prove he is Constitutionally eligible for that office before even being listed.

Cowboy, that’s my fear. The Constitution is very clear in this matter. But I can easily see the outcry if it were determined that Obama was foreign-born. There would be a Constitutional amendment in the works virtually instantly.

Thanks for the cross-post. Someone here mentioned a constitutional amendment coming quickly IF Obama is found not to be natural-born. This will be a reason for all Conservative Americans and all Democrats to end up on the steps of Congress.
For those who consider this a waste of time and money, I suggest Obama get the Bill and then we throw everyone in Congress out of office because they could have done something about this in a timely fashion. It is incredible that this issue was not resolved before he filed for office.

He wouldn’t have lost his citizenship under these circumstances. There is another reason he will not produce his birth certificate. The dems admit they actively helped the dem SOS candidates in all the states. This was done so the fraudalent votes could be counted but also so that his birth would not be an issue. And probably a whole lot more we don’t know about. This was also abetted by putting a hold on the republican FEC appointment so the FEC did not have a quoram and so could do nothing. The Obama campaign carefully considered each ramification of this election and how they could screw the system.
It wouldn’t be as easy as they might think to change the Constitution. It would have to be ratified by so many states and I doubt they are there. Of course, with the adoration of the “messiah” in place, I could be wrong. I have never in all my life seen such craziness as to put this guy on a pedestal so high when his background is so bad. We don’t even know what his policies are he has changed them so many times.
Of course, with four dems and four republicans and one socially conscious justice who knows what will happen. Kennedy might decide it would be best for the country to ignore the Constitition since the election was so divisive. He is, after all, the most powerful man in the country.

Yes, Hawaii confirmed that there was a birth certificate now locked away over there. No information on whether it has been changed, who had it registered, when, it’s just there. There’s also a BC for Obama in Mombassa, and a grandmother that stated again, as the Kenyan Obama family was celebrating the election, that she witnessed his birth in Mombassa. It was witnessed by clergy, one was present doing the questioning and another was asking the questions and listening on a speaker phone. This is all on tape, and both clergy members signed documents that they witnessed it.

I, too, think that this issue is legitimate and worth pursuing, but many conservatives are shying away from it, and some are criticizing and ridiculing it, to cover themselves in case it amounts to nothing and they come off looking like nutballs. I don’t really expect anything to come of it myself, but it’s interesting to posit. What if it were discovered that a duly elected president were found constitutionally ineligible to serve? Would SCOTUS uphold the constitution and risk riots, or would they just let it slide and render the constition, all of it, meaningless? What about the electoral college? If nothing else, it would make a great movie.
The example placed on factcheck.org is a computer generated form with a revision date of 11/01 clearly noted. A similar example of a real birh certificte, not a certification of birth, was typed on a manual typewriter. How many computers were available in 1961? Further, the example depicted clearly states certification of birth, which only means it certifies he was born. It does not state where. The hawaiian politicians were very careful in their clintonian parsing to avoid stating what they have is a “Birth CERTIFICATE”, FROM Hawaii.
In fact. If you look at his selective service paperwork you will se it is loaded with discrepancies and the signature is clearly not his.

But I disagree, especially, with the way Farah links Obama’s BC to his “natural born” status. And I’m writing this post now because I feel strongly that this error is potentially dangerous. We’ve repeated it ad nauseam on this blog: Obama’s natural-born status is in question because of his dual citizenship (more precisely multiple citizenships: British, Kenyan, Indonesian, US), NOT because of his birth place. That’s why the Donofrio case has the most merit, in our view.
Ironically, now that the election is over, the pressure is building. A few bold members of Congress are getting interested in demanding hearings on the issue. The lawsuits are increasing. More pundits and activists are beginning to mobilize…
…I, too, am raising the stakes. If Obama as born in Hawaii, he is a natural born U.S. Citizen – period.
I worked for the State Department and was stationed at the American Embassy in Athens from 1981-1984. I had two children born in Greece. Both received a certificate from the Embassy stating that they were ‘American citizens borm abroad’. They did NOT have to be naturalized, hence they are American citizens, born by two American parents while overseas. Natural born American does not mean that you have to actually be born on american soil – it means that you did not have to be Naturalized to become a U.S. citizen.
To put a final twist on it – Greece considers them also Greeks – once born in Greece – always a Greek. I am not sure if that expires wen they become 21 or not, but it is not by choice. I assume since obama was supposedly born in Hawaii (if that is not the case – that is a different issue), with a Kenyan father, he may have been born as a citized of both countries (like when a Canadian has their child born in the USA). Having Kenyan citizeship from birth does not make him less a US citizen at all. If, however, he was born in Kenya, that is a different story alltogether.

Your situation is a bit different that what Obama’s is.
Because you worked for the State Dept and were stationed overseas your children were automatically afforded US citizenship just as children born overseas to military parents are.
Obama’s situation is different in that his father was a citizen of Kenya and his mother a citizen of the US.
You are correct about his citizenship being a non-issue if, indeed, he was born in Hawaii. If he was born outside of the US however his situation becomes more complicated because his mother was not old enough at the time of his birth for him to have been conveyed automatic citizenship.
His situation is further complicated by the fact that his step father adopted him and he became an Indonesian citizen in order to attend school in that country.
The Founding Fathers’ intent when they established the “natural born” portion of the Constitution could not have been more clear. They wanted to make sure that people with dual loyalties didn’t hold the office of POTUS.
It will be interesting to see how the SCOTUS rules on this matter.
The Justices rightly consider themselves to be the keepers of the Constitution and I cannot see them allowing it to be usurped by anyone, especially an unqualified presidential candidate.

I disagree. I do believe the Supreme Court will step up and do the right thing–after all it is to uphold our Constitution. It is more important to show the world we live by our Constitution than to worry over embaressments of anykind. It will also show the world our systme of checks and balances are in place when the Supreme Court remand this to the Electors at the Electoral College. Obama is NOTHING right now…that is WHY our system has the Electoral College and state Electors. So in the case–after a popular vote vy american voters is held…any new, damaging or illegal information does surface this is another review of the situation in place.
Electors are “supposed to vote for the candidate that their statespopular vote went for”
however, Electors take an oath to uphold the constitution first…and are sworn to do the right thing for our Constitution and our country. Our country is strong, resiliant and most importantly the truth will win out. I strongly believe this fraud will not see inaugaration day.

We were pretty detailed in our calls. You can look at every hospital here and call any of them. You can file freedom of information acts, you can do everything and anything you wish. Barack Obama was never born in a hospital in Hawaii as claimed.
Only his original that he has sealed will have this info. Will the Supreme Court force it open and thus preserve the Constitution of the United States?

Hawaii Issues Birth Certificates to Foreign Born Residents!
Here’s Hawaii saying it like it it. All Doubts Cleared my Friends.
A. From Hawaii’s official Department of Health, Vital Records webpage: “Amended certificates of birth may be prepared and filed with the Department of Health, as provided by law, for 1) a person born in Hawaii who already has a birth certificate filed with the Department of Health or 2) a person born in a foreign country“ (applies to adopted children).
B. A parent may register an in-state birth in lieu of certification by a hospital of birth under HRS 338-5.
C. Hawaiian law expressly provides for registration of out-of-state births under HRS 338-17.8. A foreign birth presumably would have been recorded by the American consular of the country of birth, and presumably that would be reflected on the Hawaiian birth certificate.
D. Hawaiian law, however, expressly acknowledges that its system is subject to error. See, for example, HRS 338-17.
E. Hawaiian law expressly provides for verification in lieu of certified copy of a birth certificate under HRS 338-14.3.
F. Even the Hawaii Department of Home Lands does not accept a certified copy of a birth certificate as conclusive evidence for its homestead program. From its web site: “In order to process your application, DHHL utilizes information that is found only on the original Certificate of Live Birth, which is either black or green. This is a more complete record of your birth than the Certification of Live Birth (a computer-generated printout). Submitting the original Certificate of Live Birth will save you time and money since the computer-generated Certification requires additional verification by DHHL.”
Now that we all understand that you can be born in Madagascar, Russia, Norway, Brazil or even Kenya like Obama and still have a REAL birth certificate that both Snopes and Factcheck would say was real since they are real. That doesn’t mean you were born in Hawaii. Does this matter to America?
Barack Obama has as of November 27th 2008 spent over$500,000 U.S. to prevent others from seeing it. Why? Didn’t he already win the vote?
Please don’t bring up Snopes (link) that says THEYVE SEEN Obama’s birth certificate and it is the one on his site called Fight the Smears. That is just plain garbage as it has a 2007 border and doesn’t list the hospital, Dr. or place of birth! Plus they say they’ve seen his real birth certificate (you know the one that we the people aren’t allowed to see) .
All of the people born in Korea, Kenya, Mongolia, Australia and who also have Hawaiian birth certificates also have REAL birth certificates.
This does not mean they were born in Hawaii. Get it?
Snopes and FactCheck aren’t lying when they say the 2007 birth certificate on Obama’s site is real. So are the thousands and thousands of birth certificates in Hawaii from people born in Korea, Australia, Germany and even Kenya like Barack Obama! They are all REAL and Authentic birth certificates, but that doesn’t mean they or Barack Obama was born in Hawaii.
This is the whole point people. That is why many of us are incensed that Obama is about to become the President and may not even Constitutionally qualify to be one!
This is unacceptable to every American who understands that Hawaii issues birth certificates to those born in foreign nations.
Yes – it is a proven fact that Hawaii grants birth certificates to people born in other nations! If you or I want a copy, they produce the document that you see on Obama’s site. That is NOT the one that has what we need to see to have Obama become President of the United States.

It is never a waste of time to uphold our US Constitution and thus the wisdom of the founding fathers who wrote it to protect us from much in govenment. It also was written to keep any other country from getting a foothold in our government, thus the separation from from our former UK brethren in arms over the colonies. If we dare to ignore history, we are destined to repeat it … let’s see how brave our US Supreme Court Justice’s will be in light of the near “king” status of Obama. I love how the main stream media has so swooned over the Obama’s … the more you build them up, greater the fall in the end.

Call the Congressiona Judiciary and Rules Committee and ask them the simple questions:
What is your purpose? (to write law and require judges (U.S. Supreme Cout, etc.) uphold the constitution)?
Is there anyone or any committee who is required to be responsibe to assure all required documents are made available to the public and verified as authentic, in election candidates for Federal Level (Congress, President, etc.)? And if so who, and please connect me to them now.
The calls I have made have resulted in the speakers stumbling over their tongue (Foreign Affairs Committee, Judiciary and Rules Committee, Veterans Affairs Committee, White House Legislative Services).
And the local media here in Idaho? They say they are not interested in covering the “Is Obama Constitutionally prohibited from being President” issue. They say its not important.
Fact is 99% of media are bought and only report what “they are told to”.
I’m glad nothing takes God by surprise, otherwise I’d be scared. God bless everyone who seeks right and stands strong in it.
This is not a race issue, it is a constitutional crisis and a question of whether our nation has a future, or whether it is too late (because we who are 25 years and older) have sat on our hands and allowed this nation to fall by our laziness and our greed).
I am a white, Constitution Party member and I vote person not party (I vote for Democrats, Republicans, Constitution, Libertarian, etc. depending on the people running, and not the title they wear). One of my daughter-in-laws is black. I only bring this information in because I have heard over and again that this is a race issue, and I wholeheartedly disagree.
My son in the military says much of the military is disgusted with this whole fiasco (it appears that many of them believe Obama was born in Kenya, Africa).
Take courage, and be strong. Do what is in your power to do, and (for me) I pray, and remind God that He says He will preserve us if we turn to Him.
I want to thank all those who have worked hard with keeping up this vital issue (especially in light of the lack of proper media attention.) Strange how celebrite status on Obama and what dress Michelle will wear to the ball is more important to FOX (fair and balanced?), ABC, CBS, CNN, NBC, etc., than anything of actual value to our nation’s future.
I keep it all in prayer, and leave the results to the Creator, and thank Him for Chist this Christmas season.

Amazing how the main stream media doesnt even acknowledge for months that there were cases pending before the supreme court –and there are still 3 more pending—on different technicalities and issues of law—(they didnt dismiss the others at this time-)

and that one is still pending…so hold on everyone….the case against Obama is not closed.
in addition, the Suprmee Court knows there are alternative avenues in our system for Obama to be denied confirmation without it being done by the Supreme Court and perhaps they want it to take the proceedural path throught the election system and electoral college.
after confirmation by the electors of the electoral college there are other steps towards inauguaration..all of which have to pass protocol for obama to be sworn in. i doubt that will ever happen.
