Dishonorable Discharge and NFA Firearms

 

The dishonorable discharge is based on a general court-martial conviction. This means the conviction is a felony, regardless of what the underlying offense may have been. The convicted felon is banned from possessing a firearm including Title II Firearms (a Silencer, SBR, SBS, AOW, or Machine Gun).

A person who is convicted of a crime that is punishable by imprisonment for more than one year ( including a dishonorable discharge) is prohibited from possessing a firearm. Under 18 U.S.C. 922(g), a felon who is found guilty of gun possession may serve up to 10 years in prison.

If you have been convicted of a felony or a dishonorable discharge, be careful of constructive possession. You could be guilty of being in possession of a firearm if your spouse or another family or household member has a firearm that you “could” access.

A felon cannot buy or own a gun, no gun control laws could have prevented this. Lots of rumors only a few facts. The man was confronted by a legally armed citizen disarmed and then chased. Bad guy is dead.

This wont stop the usial gun control freaks from demanding the repeal of the 2nd Amendment like the liberal rags ROLLING STONE or TIME magazine and the Demac-RATS calling for Gun Confiscation Micheal Bloomberg and his shadow groups Everytown for Gun Safety and Moms Demand Action and of course like all brain-dead liberals they’ll blame Trump and the NRA as Obama s idiot Chicago Preist has done and the usial idiots from Hollywood and their Demand a Plan

The left will definitely rally to call for more gun control restrictions. Never mind that this shooter was DENIED the right to purchase or possess a gun. Never mind that churches are “gun free” zones. Never mind that another citizen with a gun ended the shootings. The left will construct their own scenario with which to justify more restrictions.

This tragedy illustrates what I have said here in the past. If you are rural, the response time of law enforcement is too slow to arrive to give them total responsibility for your safety. You need a fire arm to protect yourself, your family, your neighbors and your property (including livestock) from dangerous people and natural predators. I lived it.

@Bill… Deplorable Me: The Left wasted no time in calling for gun control and posting disgusting comments about the church goers being Trump supporters so they deserved to get it., there are always those that want to paint any horrible situation with politics, Others Claimed he was a nutty Bernie supporter that was into Antifa or Muslim convert.
I think its important to find the straw buyer and prosecute them. There is no way this guy passed a background check.

Straw buyers are a nasty problem the main part of this investigation should focus on how a felon gets his hands on any gun. Domestic abuse conviction will also prohibit you from owning a firearm, he spent a year in the brig for that.

In CA, I recall, the state was given 3 days to check the veracity of these gun application questionaires.
Maybe in Texas they trust too much.

Obviously he was not denied the ability to purchase or possess. As everyone knows—or should know, because the loophole in the law has been endlessly discussed and defended—there are NO federal requirements for background checks by secondary sellers. This is informally known as the “gun show loophole,” though the loophole extends to any private-party seller of a firearm.

The left calls for better regulation with every new incident of mass murder—which, in the event you haven’t noticed, are now occurring on an increasingly frequent basis. And the right predictably argues that tighter regulation would make no difference whatsoever, because scores can be mowed down by other means. Maybe the Las Vegas shooter could have attacked the crowd by driving a pickup truck off the roof of a parking garage, or by going after them with a sword.

Another two were apparently purchased in San Antonio. Regarding my comments in #12, it’s not yet clear exactly how he got around the red flags that should have appeared on a background check.

Kelley was banned (or should have been) for having a domestic violence conviction. There. Done. Kelley has no weapon. Weapons are not allowed in churches. So, what the f**k happened?

And before the first siren was heard, a citizen legally possessing a weapon stopped him.

It looks like the Air Force failed to report his conviction to the proper civilian authorities, which explains the Texas purchases from a licensed dealer. I haven’t heard what his Colorado sources were yet.
