The Justice Department on Thursday said it is dropping the criminal case against President Donald Trump’s first national security adviser, Michael Flynn, abandoning a prosecution that became a rallying cry for Trump and his supporters in attacking the FBI’s Russia investigation.

The move is a stunning reversal for one of the signature cases brought by special counsel Robert Mueller…

In court documents being filed Thursday, the Justice Department said it is dropping the case “after a considered review of all the facts and circumstances of this case, including newly discovered and disclosed information.” The documents were obtained by The Associated Press.

Elizabeth Vaughn of RedState wrote a couple of days ago that things were looking bad for Brandon Van Grack.

He was required to release all so-called Brady material, whether exculpatory or inculpatory, to Flynn, and yet did not release key documents.

In repeated filings, Van Grack has maintained that he’s fulfilled his obligations. In an October 2019 filing, in response to Flynn attorney Sidney Powell’s request for Brady materials, he stated that the government “has complied, and will continue to comply, with its discovery and disclosure obligations, including those imposed pursuant to Brady and the Court’s Standing Order.” He denied that they had “affirmatively suppressed evidence.

“The government had not concealed Brady material, he wrote, nor was the government “aware of any information that would be favorable and material to [Flynn] at sentencing.”

Except that they had and they were.

…How would Van Grack characterize the FBI’s January 4, 2017 Closing Communication which recommended the FBI close its investigation of Flynn, as its exhaustive search through government databases “did not yield any information on which to predicate further investigative efforts?”

How about FBI agent Peter Strzok’s instructions not to close the case yet because Flynn might have violated the 1799 Logan Act? Flynn was the incoming National Security Advisor for goodness sake. He had every right to speak to then-Russian ambassador Sergey Kislyak.

So, does Brandon Van Grack think that he can argue to a judge that he obeyed the judge’s orders and was not in criminal contempt?

Not sure. But he’s withdrawing from the Flynn case and all other cases he’s been assigned.

Almost as if he knows the thunder’s coming.

Who didn’t see this coming? It’s now Trump’s Justice Department. Lately it’s been apparent that it was a toss-up between the case eventually being dropped, or Trump issuing a pardon.

A very important question, of course, still remains to be answered: Will there be a Trump Total Exoneration Twitter post, or will he be able to restrain himself? I think some version of the former is far more likely.

Flynn lied to the FBI about a request he made to the Russian government on behalf of Trump’s still non-existent administration through the Russian ambassador, Sergey Kislyak, to refrain from any escalating responses to sanctions imposed on Russia by the Obama Administration. He made this request before Trump was president, when he had no legal capacity to engage in such negotiations. He signed a sworn confession stating that he had done so and pleaded guilt as charged.

In return for agreeing to cooperate with an ongoing investigation, Flynn was charged only with giving false testimony. He could have been charged with more. Flynn Intel Group was paid over half-a-million dollars for pro-Turkey lobbying efforts through Inovo BV, a Dutch company. Flynn Intel Group didn’t properly register as contracted agents working on behalf of a foreign power, as is required by U.S. law. One of the stated contract objectives was to promote the extradition of Fethullah Gulen, a lawful U.S. resident, from the U.S. back to Turkey, where he would be tried as a “terrorist”. An “enforced disappearance” from the U.S. was one of the means that was discussed—that being a euphemism for illegally removing him by way of kidnapping. (Rudy Giuliani, by the way, also took an active part in trying to persuade Trump to allow Gulen to be extradited. )

Those are the facts. It’s not as if Flynn did nothing wrong. Flynn broke laws and knew full well that he had done so. He crossed lines that he knew should not be crossed. The lie was an effort to conceal that.

In return for favorable consideration regarding his charges and the possibility of a more lenient sentence, Flynn agreed to cooperate with the investigation—but then didn’t actually do so. He accomplished a delay in the process, and then changed course because he likely had an assurance from the Trump administration that something like this would eventually happen. The Trump administration owed him. He hasn’t been rewarded for patriotism and righteousness. He has been rewarded for keeping his mouth shut.

May 7, 2020 – Trump administration asks Supreme Court to shield secret Mueller grand jury materials


The Department of Justice (DOJ) argued in its filing that breaching grand jury secrecy would have a chilling effect on future witnesses.

“Absent assurances of secrecy, ‘many prospective witnesses would be hesitant to come forward voluntarily,’ and those who do come forward ‘would be less likely to testify fully and frankly,’” the DOJ wrote, citing prior Supreme Court decisions.

Yeah, the Trump administration is really concerned about witnesses not coming forward and telling what they know—having kept 12 such with firsthand knowledge of the President’s Ukraine scam from giving testimony during the House impeachment investigation.

DOJ lawyers also argued that the lower court’s ruling was “particularly misguided” given that the initial rationale for access to the materials — the House impeachment inquiry — had already concluded by the time the March decision was handed down.

Because, unlike these redacted, unclassified transcripts of testimony, Grand Jury testimony contains sources, names and information about innocent people. If the Grand Jury testimony contained any incriminating evidence against Trump, wouldn’t Mueller’s report have indicated so? Sheesh.

Either Flynn knowingly lied under oath then, or he knowingly lied later when he renounced the sworn testimony that he submitted in a federal court in return for limited charges and a broken promise of cooperation. You can’t have it both ways.

Flynn’s mistake was hiring Covington and Burling as his legal representatives. Any law firm that would hire Eric Holder doesn’t place much stock in honesty. Covington and Burling is the same law group that defended the terrorists in GITMO. FOR FREE PRO BONO. They are also the same law group that hid thousands of documents from Sidney Powell. Hope they all, including Eric Holder, lose their law licenses.

I feel sorry for you, Comrade Greggie. Anyone who receives such incoming as you do, with absolutely no respect coming from logical people, would hang their head in shame and leave.

In one instance or the other Flynn has to have been lying. But truth isn’t something Trump supporters put any importance on. If they did they couldn’t be Trump supporters, could they?

That’s the first truth that they have to ignore. They have to pretend he doesn’t lie, or decide that lying doesn’t matter. Blame-shifting always comes in handy.

I don’t think Greg is one person. I remember the old Greg of several years ago as fairly courteous and rational, but very, very wrong.
This flaming psycho-child bears no resemblance to the older version, or even, as you pointed out, contemporary versions.
