Actually, I think people like you are largely blame for the outcome. They made it all about his illegal alien status. Their howling for his head because of that generated the pressure that was behind prosecutorial overreach, and prosecutorial overreach was what ultimately led to him getting off with little more than deportation.
The prosecution should have gone straight to involuntary manslaughter charges. Conviction for murder in California, either 1 or 2, requires that malice aforethought be established. That would be virtually impossible to prove in any courtroom, given that the victim was killed 90 feet away as the result of a single shot that ricocheted off the pavement. It probably couldn’t even be proved beyond a doubt that Jose Inez Garcia-Zarate was aware of the victim’s presence. Forcing the jury to first deliberate patently unsupportable 2nd degree murder charges likely caused them to view manslaughter with an unwarranted degree of skepticism.
Clearly this was more the fault of zealots who thought they could turn the defendant into another poster boy for the cause than of those who consistently support the same even-handed application of the law for anyone. I would put myself in that latter category. I would cut Jose Inez Garcia-Zarate no more slack than I would cut Donald Trump.

The fault lies with the “catch and release” practice. Had this piece of human waste been prosecuted with felony reentry when he was caught, and then deported, the second time, he would not have been on the streets of California.
Fortunately, he is still facing federal felony charges and hopefully he will be in prison for a good amount of time soon.

The problem is that we can’t ask that question of 10 million people and expect to get a single, rational, one-size-fits-all answer. That some shouldn’t be allowed to stay is obvious. So is the fact that others are worthier people than many natural born citizens.
To my way of thinking, Obama’s policy of prioritizing deportation to remove the former made a lot more sense. So did his policy of putting those caught entering illegally back on the other side of the border. Now were capturing violators indiscriminately and locking them up indefinitely with no real plan how to deal with their growing numbers, at a cost to taxpayers of over $700 each per day. Apparently this is somebody’s idea of a solution—possibly the private corporations that are getting paid to hold them. Somebody is also making a bundle building a wall along a 1,954 border, when many illegal residents and most contraband arrives through normal ports of entry.

Illegals are not U.S. citizens and are not entitled to be allowed to stay until they make it before an immigration judge two years down the road, if they even show up which most don’t. If they have reentered after deportation, they should be jailed, charged with a felony offense, have a trial and jailed to the maximum amount of the law.
You need to take that up with your Party as it is your Party that is encouraging illegal immigration. All those votes the Dems are counting on from illegals seem to be worth the lives of Americans.
