It may be 6-3 in terms of R vs D, but Roberts is becoming the infamous Kennedy swing vote. Roberts has become a disappointment in recent years with some inexcusable opinions. It would seem in consequential cases, Roberts has been the 5th vote in 5-4 liberal sided opinions.
The good news is in President Trump’s second term, it is likely Justice Breyer will retire. He is 82 this year and will be 86 by the end of the second term.

@July 4th American: We can hope Trump can find another originalist to drive the Democrats crazy. Not good the timing of Ruths departure. Just hope Breyer doesnt wait to retire or depart the last year of the upcoming lame duck administration.
Should be interesting. Do not know if he has any health issues. There are scores of potential originalists to put the panties of the left into a wad. Kind of like Alabama reloading every year on their football team.
Heard a very interesting perspective today on Dan Bongino’s show. He read a piece where it opined that essentially a 5-4 court may work to the advantage as being a 6-3 court. Consider for a moment that Amy Coney Barrett now becomes presumably a solid conservative vote and may sway the court on certain cases. That would leave the majority writing opinion writing to the senior most conservative in this case Clarence Thomas. Also, given Roberts’ vanity, side with the minority sidelines him from writing the opinion. For this reason it is thought he may now find himself voting more conservatively rather than abdicating the majority opinion writing, particularly on significant cases.
