Presidential hopeful Gov. Mitt Romney yesterday demanded the resignation of his own judicial nominee after she sprang a violent convicted killer over the summer, as new details emerged showing that the judge ignored warnings when she freed the ex-con, now accused of killing a Washington couple.

“There was a systematic failure in this case starting with the judge,” Romney’s spokesman, Eric Ferhnstrom, said of Superior Court Judge Kathe Tuttman. “Her decision represented an inexplicable lapse in judgment and was inexcusable. Unless there are facts unknown to us, (former Bay State) Gov. Romney believes Judge Tuttman should resign.”

As I wrote in this post, I don’t think he is completely to blame in this situation seeing as how his State has deemed it necessary to force a Governor to choose a judge from a list put together by a panel.  Add in the fact that a bunch of NOW activists were putting the screws to him and you have the making of a disaster called Judge Tuttman.

On a side note the article does include some quotes from a few other Democrats, namely Jarrett Barrios.  A gay Democrat who has tried to push through legislation in that State which would release more criminals rather then keep them locked up as they should have.  He blames Mitt because he feels the outreach program would have turned the killer around apparently. 

So basically in a case about a liberal judge
letting a violent criminal out too early, they chose to quote a guy who
wants the criminal justice system even more liberal then it already is.

I’m telling ya, you just can’t make this stuff up. 

Bet that it may, Mitt chose her, and she made a horrible decision, and this will effect his run for President a bit:

Tuttman chose instead to overrule a District Court judge’s decision to hold Tavares on $50,000 cash bail and she set him free, saying it was unlikely the convicted killer “poses a flight risk.”

Prosecutors also asked Tuttman to put a monitoring bracelet on Tavares, citing his “significant history of violence,” but the judge refused to do that, too, according to the transcript.

“It is the Court’s view that Mr. Tavares has wrapped his sentence on the underlying offense,” Tuttman said from the bench. “He doesn’t have a history of any defaults on the record. And there is no indication . . . that he is a risk of flight, other than the nature and circumstances of the charges.”

Other then the nature and circumstances of the charges?  WTF!

Do ya think the nature and circumstances of the charges should of indicated to you the guy was dangerous?

Spoken as only a registered Democrat would have spoken.

This kind of decision, along with these kind of decisions make me think twice about Mitt.  People change, people make bad decisions, I understand that….but I’m looking for that person who doesn’t change just because it’s politically expedient.

Bush never changed his tune when all the polls were against him, he did what he felt was right.  Reagan was also this type of person.

Who amongst the Republican nominee’s is that person now?

People get sent to prison, most all are eventually released from prison.

Well, you wouldn’t like my first answer. But I also think both McCain and Thompson, while not flawless, can claim to be pretty impervious to the winds of public opinion. Of course in McCain’s case that includes being out of line on a lot of things (where we might wish he *had* listened more to his constituents). Being really principled sounds great, but if someone is stubbornly opposed to you on things you care a lot about it doesn’t look so pretty.

I doubt this will be Romney’s “Willie Horton.”

He appointed the judge, but as was pointed out, from a list submitted by Democrats (same with Rudy in New York).

Michael Dukakis was Governor when the prison furlough program was expanded to include convicted murderers. Horton was released and then raped and assualted a woman while on furlough.

There are valid reasons to prefer another candidate over Romney. But this wouldn’t be one of them.

People get sent to prison, most all are eventually released from prison.

But there are those who should not be released and its up to our elected leaders to ensure those people, including a guy who hacked up his mother, stay away from the population.

I agree Mike. As I said in my post I don’t think this will be a huge issue but it will bite him a bit. I should of put in my post that I’m thinking twice about all the candidates. As I have in every election except 2004.

Your right BB, McCain most definitely has stuck to his guns but that gang of 14 really put a bad taste in my mouth. Fred is definitely on my short list, as is Rudy.

But I will vote for the Republican nominee, whoever it turns out to be.

The Judge was a formor prosicuter, what she did was uncoshionable But not a reflection on Mitt. Willey Horten was the product of a Deckous initive that he never disavouled. Go Mitt

John McCain should never get any votes. I, Being from Phoenix, have never voted for him and no one should. His behavior has always been for his benefit and his only. Having said all that Romney is not my first choice, but if nominated he’s miles above anything the Democraps have to offer. Duncan Hunter is the true conservative here, unfortunetly getting no traction, more the pity.

I agree Jain, they are all heads and tails above what the Democrats have to offer (excluding Paul).

Maybe it’s just me … but i am more pissed at this worthless turd of a judge, whose worst possible punishment for negligence and contributing to crime is to retire to Florida a little early!
I am not as of yet on the Mitt train, but what were his current options? The only other human i can recall to call out these judicial “criminal enablers” was John Walsh on his show. Maybe if our judges werent “above the law” things would be different.
I can see the MSM spinning this issue right out of the playbook, though.

I heard Mitt on the Bill Bennet Show this morning. He stated this was the best qualified judge available (of the list he was presented by his leftist legislature). She had 17 years as a prosecuter and this ruling, with all of its stupidity, was a shock to him and he wants the judge to step down.

He could turn this into a call for reform of the judiciary, which would REALLY piss-off the left as the judicial “oiligary” is where their power and so-called “progess” reside.

And I do not think this guy spent any time in jail. He was released on his own recongasense with no bail set. “Bail” would indicate that he was not yet tried.
