Marilyn Mosby just bought herself some trouble over Freddie Gray

We’ve now had the better part of a day to absorb all the information coming out of the rather stunning announcement from Baltimore City State’s Attorney Marilyn Mosby, which Ed covered yesterday. After she leveled very serious charges against six police officers related to the death of Freddie Gray, Mosby was immediately being hailed as a hero by the usual sources on the left. But now that I’ve had some time to go over the charges and what’s been revealed of the case thus far, it seems very likely that Ms. Mosby, barely three months into her first elected office, has grabbed a tiger by the tail.

To be clear, as I wrote earlier this week, it’s certainly possible there is sufficient evidence of wrongdoing in this case to merit charges against one or more police officers, but we won’t know that until all the evidence is presented as the state prepares to go to trial. But from what we have managed to learn thus far, some of the charges Mosby has delivered look like a dramatic overreach. In particular, tagging Caesar R. Goodson, Jr with second degree depraved heart murder will be a serious stretch, considering the need to prove intent (on top of everything else) against someone who was walled off in the driver compartment of the vehicle and unable to reach – or for the most part even see – Freddie Gray. As things stand, involuntary manslaughter might be the best the state could hope for.

But even if we are to accept that the state’s investigation has revealed sufficient evidence for such charges, the handling of this case by Mosby thus far is only handing ammunition to the defense. I was particularly struck by the tone and wording of Mosby’s speech, which veered far from any pretext of the rule of law and well into social justice territory regarding law enforcement officials who have yet to have their day in court.

“To the people of Baltimore and demonstrators across America, I heard your call for ‘No Justice, No peace,’” she said. “Your peace is sincerely needed as I work to deliver justice on behalf of this young man.”

This should be alarming to anyone in the justice system. Cries in the streets of “No Justice No Peace” are certainly protected, First Amendment speech, but they are also a strongly implied threat of lawlessness which stands apart from whatever perceived injustice is being protested. To have the State’s Attorney echo that on the steps of the courthouse was off-putting to say the least. What’s more, it was a very direct signal that the crowds threatening the state with “no peace” had secured a victory by having Mosby stand up in public and declare that she would “deliver justice” for Freddie Gray long before there has been a trial, to say nothing of a conviction of officers who are innocent until proven guilty. How does one promise what justice will look like before a determination has been made?

she also has a financial relationship with the Gray’s attorney, and so does her husband. think that is a conflict of interest? If this happened in Ferguson and Wilson’s attorney had a relationship with the prosecutor, all hell would have broken loose.

IMHO this is strictly a political move. the mayor inserted both feet into her mouth, and this woman is doing the same. patronizing the rioters, if you asked most of them they wouldn’t have a clue who they were protesting/rioting for.

She might reap what she has sown.

Didn’t Mosby also charge the two arresting officers, although a video of Gray getting into the wagon shows him to be fine?

Yeah, it’s a stretch according to Alan Dershowitz and a “sad day” in jurisprudence. Mosby was simply pandering to the rioting crowds.

There is no doubt that the police officers will have excellent legal representation and the first thing that will be requested will be a change of venue. If that is not granted, the judge will have set themselves up for an immediate appeal.

“No peace, no justice.” Right out of tax dodger and race baiter Al Sharpton’s mouth. There is none so despicable as he.

State’s Attorney Marilyn Mosby has an assistant named Bledso.
Bledso has a lesbian lover who works for local media.
After the damning WaPo article about the 38-year old man in the van with Freddie Gray saying he sounded like he was trying to hurt himself, Bledso’s lover published a FALSE story about a 22-year old man she claimed was THE man in that van as if his telling a different story was a recanting of another man’s story.

CNN’s Don Lemon was confused as to how this free 22 year old kid could be the still-imprisoned 38-year old man from the WaPo story, so he asked either Mosby or Bledso.
Whoever he asked CONFIRMED this was the same guy!
So, she’s got a real problem on her hands.
Have you even seen a case where a witness lied in the past but is swearing he is telling the truth now?
The jury is free to discount his words because he freely lies.
How much more so when it is the prosecutor!

This is another case of a liberal kicking the can of responsibility down the road and hoping for some turn of events to pull their fat out of the fire. Mosby had, in essence, negotiated with terrorists and given them 6 victims if they will just stop burning the city (we will see if that deal holds). However, based on the overly serious charges against the driver, perhaps the goal was to bring serious charges with the hope of turning all the responsibility over to the courts instead of simply doing the right thing at the right time.

Does anyone expect the driver to be found guilty of depraved 2nd degree murder for not buckling Gray into his seat? Remember, in the Zimmerman trial, jurists voted him not guilty even though they personal thought him guilty because the evidence presented did not prove guilt. There is hope for a fair trial, but since Zimmerman, we have had Brown, Garner and Scott and even though the law has taken its due course in each of those incidents, the racist left has not yet gotten its pound of flesh.

Maybe the purpose of the extreme charges is to see them found not guilty. But, if so, what will happen then? We still see idiots chanting “Hands Up, Don’t Shoot” and there are enough of those to incite violence on a whim. No matter what the “strategy” was with these ridiculous charges (not that there should not have been any charges… we do not know all the details) it will end in more violence.
