Will Hillary be taken down by a weiner?

Ironic, yes, but don’t get too excited. It might be different had Comey not so totally screwed up the investigation from the start.

Unexpectedly, the FBI has decided to re-open its investigation into the clinton emails:

An October surprise exploded in the presidential race Friday.

The FBI suddenly announced that it is reopening its investigation into Hillary Clinton’s emails after learning of new documents “that appear to be pertinent to the investigation.”

The bureau’s stunning move came less than two weeks before Election Day.

“In connection with an unrelated case, the FBI has learned of the existence of emails that appear to be pertinent to the investigation. I am writing to inform you that the investigative team briefed me on this yesterday, and I agreed that the FBI should take appropriate investigative steps designed to allow investigators to review these emails to determine whether they contain classified information, as well as to assess their importance to our investigation,” FBI Director James Comey said in a letter to House Oversight Committee Chairman Jason Chaffetz.

Seems that in the course of investigating Carlos Danger’s sexting a 15 year old girl emails were discovered on the computer shared by Huma Abedin and Weiner.

FBI Director James Comey told members of Congress in a letter that “in connection with an unrelated case, the FBI learned of the existence of e-mails that appear to be pertinent’’ to his probe.

A law-enforcement source told The Post the e-mails came from an electronic device seized from Weiner and his wife, top Clinton aide Huma Abedin, as part of the federal investigation of Weiner’s ­sext messages to a 15-year-old girl.

The feds confiscated four devices from the two, including a laptop Weiner used to send sleazy messages to the teenager.

They also found e-mails that Abedin either sent or received on the laptop they shared. The lead investigator in that case reported them to Comey.

This entire episode has made me extremely cynical and caution is indicated:

At the same time, however, given that we do not know the significance of this newly discovered collection of emails, I don’t want to create a misleading impression. In trying to strike that balance, in a brief letter, and in the middle of an election season, there is significant risk of being misunderstood, but I wanted you to hear directly from me about it.

Indeed. Now on the one hand, you have to think that if the emails were all yoga routines and wedding plans the FBI would be dismissing what they found and the investigation would not be re-opened. On the other hand the investigation has been so compromised that it’s hard to imagine this amounting to much. No one knows what’s in these emails as a warrant is required to open them. The scuttlebutt is that there a large number of them on the computer.

There is a fun part to this. Comey was the darling of liberals once he announced his opinion not to bring charges against clinton but now their heads are exploding:

Comey's substance-less bombshell couldn't be timed more irresponsibly. If he has evidence, he must release it immediately.

Comey acted not as an impartial investigator, but rather as a clinton advocate throughout the process. Key witnesses, including the clinton “fixer”, were immunized. Cheryl Mills was allowed to act as both a witness and a clinton attorney. Comey allowed the witnesses to destroy evidence and dictate the terms of the investigation:

Immunity deals for two top Hillary Clinton aides included a side arrangement obliging the FBI to destroy their laptops after reviewing the devices, House Judiciary Committee sources told Fox News on Monday.

Sources said the arrangement with former Clinton chief of staff Cheryl Mills and ex-campaign staffer Heather Samuelson also limited the search to no later than Jan. 31, 2015. This meant investigators could not review documents for the period after the email server became public — in turn preventing the bureau from discovering if there was any evidence of obstruction of justice, sources said.

The Republican chairman of the House Judiciary Committee fired off a letter Monday to Attorney General Loretta Lynch asking why the DOJ and FBI agreed to the restrictive terms, including that the FBI would destroy the laptops after finishing the search.

Not only did Comey not convene a grand jury, he blocked it:

A high-ranking source from within the agency told Fox News that agents involved in the Hillary email investigation were sickened by the decision to let her skate free of any accountability. The source said it was pretty unanimous among the agents that Clinton should have lost her security clearance, and that a majority felt she should be prosecuted. Over the weekend, former U.S. Attorney Joseph diGenova said that Comey is viewed as a “dirty cop,” noting that there appears to be an internal revolt against his leadership.

Now, we have two more agents coming forward saying that a grand jury should have been convened, and that Comey simply “stood in the way” of that. One thing that was odd about the investigation was that the FBI didn’t search Clinton’s house. Moreover, these agents were agitated that Comey kept referring to the Bureau (i.e. we) for discussing why no charged were filed, adding that he was never a special agent or an investigator in his legal career.

Comey did everything but shut the investigation down:

“We didn’t search their house. We always search the house. The search should not just have been for private electronics, which contained classified material, but even for printouts of such material,” he said.

“There should have been a complete search of their residence,” the agent pointed out. “That the FBI did not seize devices is unbelievable. The FBI even seizes devices that have been set on fire.”

No search warrants, no subpoenas:

Napolitano agreed, saying the FBI investigation was hampered from the beginning, because there was no grand jury, and no search warrants or subpoenas issued.

“The FBI could not seize anything related to the investigation, only request things. As an example, in order to get the laptop, they had to agree to grant immunity,” Napolitano said.

Comey never put clinton under oath.

It was upon all this sterling gumshoe detective work that Comey decided there was no intent on clinton’s part to be “extremely careless” in handling classified materials. He seems not to have left a single possibility for clinton facing accountability on the table.

Comey did not act as the Director of the FBI – he acted as the chief clinton attorney. So as much as I would like to see otherwise I do not believe this will reach hillary clinton. You might think that Huma Abedin would be at risk, but she’s already been immunized.

So where can this go? At the end of the day, I suspect that all the FBI will have on its hands is a weiner.
