Democrats are fine with unconstitutional … How are they going to enforce it? There is no Constitutional referee in our system … It’s up to us.

who is this Parlimentarian that can’t seem to read ? looks like another liberal in public service who lets party rule over the law …

Bad year for these points of order… McCain’s attempt in Feb 2009 failed 62-36 INRE DC voting rights. In July, Cobun’s attempt at the same tool failed 70-23 INRE the Durham Museum in NE.

Like you said, only got 40 votes and hard for this stuff to work.

Democrats can’t read, neither their oath of office, nor the Constitution …

Our Constitution was made for people of high moral standard, not Chicago thugs. When the Constitution was written it was noted by John Adams

“We have no government armed with power capable of contending with human passions unbridled by morality and religion. Avarice, ambition, revenge, or gallantry, would break the strongest cords of our Constitution as a whale goes through a net. Our Constitution was made only for a religious and moral people. It is wholly inadequate for the government of any other.” — John Adams

I guess that leaves out Muslims, Democrats and Indonesians.

@MataHarley: I’m sure you are pleased, as I am, that DeMint raised the objection despite it’s prospects.

Certainly pleased at the attempt, Mike. Holding out “hope” for “change”? Hang no… Will the Dems find a way to spin this as another “party of no” attempt? Probably.

Every year since who knows when, the Enumerated Powers Act is introduced in both houses of Congress, and every year it dies in committee. It reads:

“Each Act of Congress shall contain a concise explanation of the specific constitutional authority relied upon for the enactment of each portion of that Act. The failure to comply with this section shall give rise to a point of order in either House of Congress. The availability of this point of order does not affect any other available relief.”

I’m pleased that Demint made this move, but it’s like having 60 wolves and 40 sheep vote on what’s for dinner.

Edit: Well this was predictable: Reid, McConnell Reach Deal to Adjourn Early

Now, apparently Linsey Grahamnasty has his SC Attorny General looking into the legality of Ben Nelsons bribe…, er, sweetener. Now, Nelson is considering dropping his deal. Pass the popcorn!

@John Cooper: Good grief John! You can’t at least praise our team without damning them! At least you didn’t cite the incendiary Fried State post on that subject.

I’ll praise ‘our team’ when they actually win for a change, not before. Remember that line from the movie Top Gun? “VIPER: That was some of the best flying I’ve ever seen, right up until the time when you got shot down.”

@John Cooper:

Edit: Well this was predictable: Reid, McConnell Reach Deal to Adjourn Early

John, I have to agree with you on this portion at least.

It seems to me that something so fundamentally important as this piece of legislation is worth fighting tooth and nail to the absolute last tactic.

This is not the type of thing that you fight for until oh, let’s say 3 o’clock, and then pack up and go home.

This is the future of OUR country that is at stake and our side should be fighting to the last man right up until the last minute.

We should be making the Dims work for this thing.

The longer it drags out, the more the American People learn about it, the greater the groundswell of opposition. Just look at what has happened to Obie’s poll numbers since Sunday.

The Congresscritters on our side should read about General Washington and the Christmas of 1776. There are valuable lessons to be learned there.

God Bless Jim Demint — he stands with the people. . .every time we show up in DC — he is there. He needs to ramp it up! Harry Reid’s “Can’r we all just get along” speech is pathetic in light of what he and his minions are trying to do/

Hey Harry, should we just roll over while you steal our liberties? . . .No way!

God save the USA — hope for a civil war at the ballot box and in courts — not otherwise. There is a growing anger that is very close to bubbling over. . .so close, this topic is an unabashed open air discussion. . .

@John Cooper: If you plan on waiting until the GOP has a majority before you praise them then you better get used to Nancy Pelosi as Speaker and Harry Reid as Majority Leader.

When your team does something right, they deserve your thanks. Otherwise, why should they bother?

We know the HC bill, both versions, are seriously flawed. Both versions are largely unconstitutional in scope, the amount of power transferred to the federal government with no checks and balances. Both heavily laden with pork.

Remember, much of FDR’s depression-era New Deal programs were ruled unconstitutional by SCOTUS.

Force the vote on the point of order. At least they will be on the record.

@ Aye

I think Mark Steyn / Andy McCarthy have the situation figured out in Mark’s Dems Strategic / GOP Tactical Theory

That is, our guys are focused myopically on a battle the Democrats have already figured they can afford to lose. The real battle is: What do you do when you get back in power? Do you have a plan for how to undo what is being done? Do you frame the coming elections in a way that converts victory into a mandate not only to stop what Obama is doing but to undo what he has done?

I’m hearing a lot from our side about making big gains in the upcoming elections. That’s not strategy or victory. You have to have a plan for what those gains would translate into. Democrats, by contrast, have a real plan for how what they’re doing today will sustain Big Government, and themselves, over the long term, regardless of occasional electoral losses.

I applaud the valiant effort of individual troops like Demint, Coburn, Burr, and many others, but their “generals” don’t seem to have a clue. It’s my sense that nobody in the (alleged) Republican “management” has any long-range plans at all (other than get more RINOs like Arlen Spector and Arnold Schwartzenegger elected).

Ayn Rand was pretty rough on conservatives back in 1960 when she wrote that they have “no goal, no direction, no political principles, no social ideals, no intellectual values, no leadership to offer anyone”, but it’s hard for me to argue with at least some of that.

McConnell made a deal to adjourn early for a (kinda) good reason.

1. There is nothing (other than to delay till midnight the 24th), that can stop this vote on or before Christmas.

2. Everyone is tired (esp the Dems) and wants to go home.

3. There is an important vote to up the debt-limit on the docket.

4. Obama has a state of the union speech to give soon.

5. McConnell made a deal with Reid to have the debt-limit vote on the same day as Obama’s speech about the state of the union, which most voters see right now spelled as: e c o n o m y.

If Reid holds to his word (????) McConnell made the best deal he could, and now gets to go home…then make Obama/Dem look stoopid and foolish the day of Obama’s SOtU.

Not a bad chess-move, but it depends on Reid’s “honor”…. (Yeah, I know.)

Laws that cannot be reversed?? Is this America??? Or some Dictatorial Kingdom??? We don’t have KINGS here who rule without question … and to even CONTEMPLATE trying to pass “non-undoable” legislation is IMHO “Treasonist”as well…. WHO is around who can CHARGE such a crime?? Not that weasel Holder…..

@John Cooper: Have you ever criticized Obama on these pages? If so, I can’t recall.

Hey Cooper, I want you to watch what happens to Charlie Christ in Florida because he is a RINO! Conservatives are going to kick all these good for nothing RINOS out of office. Americans want the real McCoy; if I want a Democrat in office ,I will vote for him/her and not for a Liberal Republican, get that!

@URI

Umm. Cooper’s on your side of the discussion. Hates da RINO’s.

There’s the rub, though…What is the long-range plans for the Republican’s after 2010?

In all honesty, I can’t say that I know. I guess it’s win first, figure it out later. I sure do want a reason to be an enthusiastic supporter, and not just a shallow: “Thank God for Republicans!” person.

>>>What is the long-range plans for the Republican’s after 2010?<<< That's just it, we DON'T know!!! But, we better!! And THEY had best be coming back, hat in hand, admitting straying, and then telling us EXACTLY where they are headed...and it best be Conservative Fiscal policy... and HEAVY on "Law and Order"!!!! Time to take these cheats in Government and make examples out of them.... JAIL TIME~!!!

Will any republican force the bill to be read??!! Or will they all puss-out like mighty Mitchie.

@OLDPUPPYMAX: They forced the reading of the sanders amdendment and Reid’s managers amendment. None of that was widely reported.

Mike–

You keep slamming Erick at RedState, but how the heck did he get this if he’s a wannabe?

We Have The Actual Roll Call Sheet. Nelson Was For It Before Being Against It

I’m impressed…
