Or Hoax? Got the message, SueK and AdrianS…

When SueK posted a link in a comment to ObamaCrimes.com at 10:09A today, I went and scanned the news that Philip J. Berg, a Lafayette Hill, PA attorney, had filed a restraining order to prohibit Barack Obama from running for President. Since I was on the fly for work, I set aside indepth reading until later.

Then, at 2:53P, 2:56P and 2:57P, AdrianS followed up with the same link, on not one, but three different threads.

Do I sense some urgency here?? LOL Okay, group… got the message to put it somewhere everyone can find easier, right? Here it is… it’s own post. And thank you for the heads up… both of you. (maybe… unless it shows up as an urban legend! heh)

First of all, the ObamaCrimes site they linked to is the gold mine of data because it contains PDFs of the filed briefs. Haven’t had a chance to read them yet. And since this hasn’t hit the MSM that I’ve seen yet, I thought I’d find out more about the attorney.

He’s definitely an activist. And not likely to be conservative in leanings. His bio, per the 911forthetruth blog, show that Berg’s dabbled in such low profile cases such as challenging the 2000 election, called for the voluntary disbarment of three Supremes via letter in Dec 2001, and branched out also representing PAWS to protect the rights of performing elephants. (yes, Virginia… there *is* sarcasm in this paragraph)

Berg apparently has (or had?) a blog at the 911forthetruth site, but it’s out of date. The last entry was May 30th, 2005, posted from Madrid.

Well look out Obama… Mr. Berg has set his sights on you in a way your campaign cannot ignore…. the US courts.

Berg vs. Obama, Civil Action No. 08-cv-4083, seeking a Declaratory Judgment and an Injunction that Obama does not meet the qualifications to be President of the United States. Berg filed this suit for the best interests of the Democratic Party and the citizens of the United States.
Philip J. Berg, Esquire stated in his lawsuit that Senator Obama:

1. Is not a naturalized citizen; and/or

2. Lost his citizenship when he was adopted in Indonesia; and/or

3. Has dual loyalties because of his citizenship with Kenya and Indonesia.

Berg stated: “I filed this action at this time to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.

What immediately leaps to mind is that he is a Hillary supporter. Indeed, this is what The Digital Journal: The Power of Citizen Journalism opined in their headline on their post today. James I. Nienhuis from Dancing from Genesis also has this posted at his blog, also with the same suggestion that perhaps the Hillary campaign has “pulled the trigger”. Nienhuis is a Dartmouth grad with a B of Sc. Somehow I’d like to believe he doesn’t get pulled into hoaxes easily…

The Hillary Clinton Forum is calling it a hoax… but I’m not so sure. Certainly the legal briefs carry a signature, but there is no filing date stamped on these copies. So it could, or could not be a hoax. It’s not impossible for one to do this, and if Berg’s history is indeed historically correct, it sure is his style and issue.

UPDATE: One Hillary Forum poster named Lynfreedom posted the below:

just called the PA courts. Berg did indeed file the lawsuit yesterday. This is not a rumor. it was done. When I ask her if it could be looked up on line, she said you need name, case number, etc. and when I told her what it was she said oh that was just filed yesterday. And, I will say her tone went from serious to gleeful.

BTW, ignore the later post by “thebword” that says BHO and Berg went to Harvard together. She was using a Philip C. Berg, not Philip J. Berg.

As far as a Hillary supporter? Possible. There is no donations on record for a Philip Berg from PA to suggest that is true. It’s unlikely he’s a McCain supporter, so again… not impossible.

Anyway… breaking rumor, or breaking news… one or the other. Just passing it along with a louder voice than Adrian and SueK had. But rumors/stories like this can’t be kept down. Someone will be able to wander in the PA federal courts and verify if the briefs have been filed or not. The rest of us? We’ll be waiting….

The question isn’t whether or not he’s a _naturalized_ citizen, but whether he’s a _natural born_ citizen. Apparently the birth certificates that have been made available on line are counterfeits - but why? why not just submit an original? If you check the texasdarlin site, lots of theories offered… as well as a list of Obama related documents that somehow are just not available. And not just the Annenberg documents.

And interesting that it’s come to a head just before the convention…tell me again…is there any way Hillary can still become the nominee???

If she does, I suspect there’s going to be h*ll to pay!

If it is tru it will probably be thrown out, because there is not evidence or proof of any of it. It is funny how the story of the COLB has changed every time it is debunked. Just another silly story for the silly season known as Campaign season.

Reading thru the docs inbetween stuff now, Stix. He’s named BHO, The Dem National Committee, the FEC and “Does 1-60 50″… sorry, typo! (which I assume is meant to be John and Jane Doe?)

Reading thru the brief, he presents enough argument that it may not be thrown out of court. I believe it is meant to force Obama to bring in substantiated proof of birth to assuage the arguments. It will then take the courts to determine if the documents are valid and genuine.

The docs include the motions (and additional memoranda) for temporary restraining orders, and a declaratory and injunctive relief. The restraining order was to force expedient discovery.

Tisn’t likely this will be heard before Monday, yet with the DNC plus the FEC named, one would think it would get into the docket quickly. But the motivation is somewhat bizarre. If it was to clear the path for Hillary, it should have been done at least a month ago.

In all charges, and against all defendents, Plaintiff Berg is asking:

WHEREFORE, Plaintiff respectfully prays that this Court:

A. Declare that Defendant Barack Hussein Obama, a/k/a Barry Obama, a/k/a Barry Soetoro, a/k/a Barack Soetoro, a/k/a Barry Dunham, a/k/a Barack Dunham is ineligible to run for United States Office of the President under the United States Constitution, Article II, Section I;

B. Preliminary and permanently enjoin Defendant Barack Hussein Obama, a/k/a Barry Obama, a/k/a Barry Soetoro, a/k/a Barack Soetoro, a/k/a Barry Dunham, a/k/a Barack Dunham from running for United States Office of the President;

C. Preliminary and permanently enjoin Defendant, The Democratic Committee from nominating Defendant Barack Hussein Obama, a/k/a Barry Obama, a/k/a Barry Soetoro, a/k/a Barack Soetoro, a/k/a Barry Dunham, a/k/a Barack Dunham as the Democratic Nominee;

He may indeed prove to be, oh FA compassionate kingpin.

However one thing about lawsuits… they can put everything on pause until a dispute is settled. If the court determines he has presented a case that warrants hearing, then Obama’s in deep do dooo…. right along with the DNC

I think if Hillery is indeed behind this, than they have evidence to back up their claim. This reminds me of the good man who released Bush’s DUI. They are out there folks, some with evidence, and some blowing smoke. I guess we will find out soon, yippie get the popcorn this is going to be fun.

Wayne Madsen, Journalist with Online Journal was a contributing writer and published an article on June 9, 2008 stating the GOP sent a research team to Mombasa, Kenya and located a Certificate Registering the birth of Barack Obama, Jr. at a Maternity Hospital, to his father, a Kenyan Citizen and his mother, a U.S. Citizen.”

Not only that, but apparently no one has been able to find a record of birth in any of the Hawaiian hospitals. ‘61 is a long time ago, and records were not as available as they are now, but still - it wasn’t in the stone ages!

Apparently there are quite a few things that are usually available that are not available for Obama. I’ll try to find the list I saw.

But why not just produce the birth certificat in the original??? If he’s completely legit, not to do so is just plain dumb.

Berg has been in practice for 37 year. He was Deputy Attorney General underseveral administrations in Pa. As far as 911 is concerned there are now a number of architects and engineers who also believe that twin towers was a ‘controlled demolition.” as far as the birth certificate is concerned. the on on his website was examined by 2 forensic experts who declared it a fraud. then 2 hours after Berg filed the lawsuit, factcheck.org released a statement that the birth certificate was authentic, had a seal and a signature, etc, etc. However, factcheck is run by Annenberg foundation which is controlled by Ayers and Obama.
If you look at the photographs they offer as “evidence”, it’s just more of the same junk and again has been debunked. Looks like more and more they don’t really have a valid certificate. Berg has stated that if the Obama campaign just produces the necessary documents, he will walk away and drop the case.
Why not?
