Right you are crosspatch:

Indians are the fastest-growing group of illegal immigrants in the United States, stated a Department of homeland Security report in February 2008. The report says there are 2,70,000 unauthorized Indians in the United States - a 125 percent jump since 2000, the largest percentage increase of any nation with more than 100,000 illegal immigrants in that country.

The report says though the number of Indian immigrants is low when compared to people from Mexico, the Indian context is appalling as the illegal immigrants mostly consist high-skilled workers. Illegal immigrants from other countries are mostly low-skilled workers. If the trend continues India will only trail only Mexico, El Salvador and Guatemala in illegal immigration. The report quoting experts says virtually all immigrants enter the US legally and then violate the visa terms, thus becomimg illegal immigrants. "They come here as professionals, most often in the H-1B program, and given the fluctuations of Silicon Valley, the business climate, these guys lose their jobs. They get laid off or they wager their hands on a start-up coming in."

"The problem with the H-1B program is, you can't have any significant time between jobs" without falling out of legal status. “Indians made up 44 percent of H-1B applicants in the 2005-06 fiscal year, five times the number from second-place China, the report says. The report says another source is relatives from India who arrive for a visit on a tourist visa and never go home. http://www.rediff.com/news/2008/feb/19us.htm

Jeffrey Passel of the Pew Hispanic Trust estimates that the number of “illegal Indians” in the U.S. is about 400,000.

Overstaying a visa, which is a violation of our immigration laws, should also be considered a crime.

First of all, I am all for a state cutting off Community College benefits for non-residents. And that goes for non-residents who are Americans and attempt to cheat by falsely claiming state residency.

Secondly:

"Illegal Immigration IS A CRIME:"

The cited statute only covers those avoiding border checks. It doesn't cover people who enter with proper paperwork and never leave. The fastest growing (in percentage growth) segment of people here without proper authorization are people from India who have come on a legitimate visa and simply stayed.

Thanks for the comments. I wrote this piece for our (very liberal) school newspaper and received some serious flack, but that's what I was looking for :-) I live in Connecticut, illegal immigration is a BIG problem here but I can't imagine how bad it is for you guys closer to the border. I've personally lost two high paying toolmaking jobs in the past 10 years to inexperienced illegal immigrants. This is what prompted me to go to "J" school. Of course I reported my employers to I.C.E. but to no avail. Keep fighting the fight and maybe one day we'll get the wall built.

I love being called a racist when I talk about ILLEGAL IMMIGRATION. It shows how ignorant the other person is. Where I live, most illegals are from Mexico. Mexico is not a race. Mexico is a country. Ask them what the country of Mexico does to the illegals that cross its southern border! Illegal aliens have depressed wages for jobs that used to pay enough for Americans to earn a living. My father and uncles all worked in the construction trades. Most are dead or retired. They were skilled in carpentry, welding, electricians, etc... Nowadays, all of the construction is done by illegals, unskilled illegals. A Mexican with a hammer is not a craftsman! The quality of housing here is horrible. Many of the houses in my neighborhood are made pretty shabbily. The builder is going out of business because of all the construction defects that they have had to repair. My roof had to be redone because it wasn't built right. About a third of the houses in my neighborhood have had warranty repairs done! Serious warranty repairs costing tens of thousands of dollars!! It is costing us more than we realize to get cheap services and goods from illegal aliens. Also, my wife is Hispanic. Her family has been in Texas since before the Texas Revolution from Mexico!!! The border crossed them!

You would not believe the change here in Arizona since we passed the employers act. Traffic is so much less, fewer people standing on private properties looking for work. The moral is make illegal activity illegal and they will go home on their own, no need for deportation.

WHY ADMITTING ILLEGAL IMMIGRANTS TO COLLEGES IS BAD PUBLIC POLICY

North Carolina Attorney General, Roy Cooper, has just issued a directive that North Carolina colleges should abide by federal immigration law and not admit illegal aliens. The community college system has complied but the state universities, notorious hot beds of liberalism, are dragging their feet.

According to estimates, the previous open door policy in North Carolina of allowing illegal aliens to attend community colleges would cost taxpayers between $6 million and $8 million. If that program expanded (more illegal alien students than anticipated), costs will increase. http://www.jwpcivitasinstitute.org/media/publication-archive/fact-sheet/fact-sheet-n-c-community-colleges-and-immigration

The previous policy – in violation of the federal Immigration and Nationality Act – encouraged and induced illegal immigration by providing illegal immigrants with a taxpayer-subsidized education. By preparing illegal immigrants to enter North Carolina’s workforce, the previous policy also ignored the fact that under the Immigration and Nationality Act it is illegal to employ an illegal alien.

The directive issued by Governor Easley and carried out by Martin Lancaster (Community College President, at that time) in November 2007 asks taxpayers to subsidize the education of undocumented aliens who are not in the country legally and cannot legally work in North Carolina or in the United States.

This plan charged illegal immigrants with out-of-state tuition. On average, out-of-state tuition covers only 50 percent to 70 percent of the total costs of education.

Alternative figures released by the community college system regarding the costs to educate an out-of-state student do not include capital costs. According to the North Carolina Community College System Fact Book: http://www.ncccs.cc.nc.us/Publications/docs/Publications/fb2007.pdf , tuition funds comprise only 12.5 percent of total community college operating expenses. State and local funds – i.e., state and local taxpayers – comprise 82 percent of all funding for the community college system.

In 2005, legislation to grant illegal immigrants in-state-tuition was considered by the North Carolina General Assembly. According to Civitas’ April 2007 DecisionMaker Poll ( http://old.jwpcivitasinstitute.org/keylinks/Polls/2007-April-Poll.pdf ), 70 percent of voters oppose giving illegal immigrants in-state tuition.

Here’s examples as to where the misguided and unlawful policy of allowing illegal aliens into colleges can lead:

In 2001, Texas granted in-state tuition to illegal immigrants. In 2005, Texas reported a 900 percent increase in enrollment of illegal immigrants in state higher education institutions and community colleges.

In comparison, California likely has more than double the number of illegal immigrants enrolled in state colleges and universities than Texas. According to a recent Legislative Analysis Office report, there are up to 20,000 immigrant students in California receiving waivers from the state for tuition, both legal and illegal. The report said that about 90 percent of the immigrant students in California’s Community College system alone are undocumented. This means that there could be as many as 18,000 illegal immigrants enrolled in California State University, University of California and community colleges receiving heavily subsidized in-state tuition rates at the cost to the taxpayer of about $117 million per year. http://www.californiachronicle.com/articles/48870

It's a simple fact. If you are in the country illegally then you are in the state illegally. If you are an illegal alien then you are an illegal resident and therefore not a resident at all. You should receive no government services nor any benefits for being here. That includes admission to college.
