Obama’s Judicial Activism

Great Rudy Giuliani interview on Fox in which he had to correct Obama’s vision for judges. Social activism: (h/t Hot Air)

Barack Obama has always believed that our court should stand up for social and economic justice, and what’s truly elitist is to appoint judges who will protect the powerful and leave ordinary Americans to fend for themselves.

Need anymore proof that Obama will appoint judges who have a obvious agenda with their thumbs on the scales?

Basically he is saying that he prefers judges who favor certain groups over an evenhanded application of the rule of law.

Un-freakin-believable

Ah yes, the favorite tactic of the radical left; when the American people show their distaste for your agenda via propositions and election of conservative or moderate legislators, you can always count on an activist judiciary to come through for you.
Out here in California we’ve had a taste of that first hand. Both proposition 187 and 209 (designed to stem the flow of illegal aliens into the state by denying them services, and to banish affirmative action from our public universities) passed with flying colors among the general electorate. So, what did our resident lefties do? They whipped out their ACLU lawyers, and got injunctions put on those propositions right away. Now, those props are still in legal limbo, and if they lose their current line of appeals, they can always change their line of attack, and count on a sympathetic judge to grant a continuance of the injunction. Fortunately, by other means, affirmative action has been put on the run in our public universities (which has seen the academic standings of the U.C.’s steadily rise). However, illegal aliens are still able to receive many public services here in California…
This goes to the core of the BHO brand of radical liberalism, which believes that rather than being static, and the bedrock document of our legal system; that the U.S. Constitution is a “living, breathing document,” which liberal judges are free to interpret as they see fit. The founding fathers are rolling over in their graves at the sound of some of the tortured legal reasoning that has been used to justify liberal interpretation of the Constitution. I love the bit from BHO about the courts “should stand up for social and economic justice,” that’s something that Marx, Engels, or Lenin could have come up with! The law isn’t SUPPOSED to be favor one side or the other; it’s supposed to decide which one is right based upon what is laid down in the Constitution. A BHO inspired Supreme Court, now that’s a VERY scary thought…
