The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.

The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman’s constitutional right to an abortion.

The opponents of the act "have not demonstrated that the Act would be unconstitutional in a large fraction of relevant cases," Justice Anthony Kennedy wrote in the majority opinion.

The decision pitted the court’s conservatives against its liberals, with President Bush’s two appointees, Chief Justice John Roberts and Justice Samuel Alito, siding with the majority.

Justices Clarence Thomas and Antonin Scalia also were in the majority.

It was the first time the court banned a specific procedure in a case over how — not whether — to perform an abortion.

Thank you President Bush!

This would have never….NEVER had happened without Bush being in office and pushing through Alito & Roberts.

And this is a reminder that the next President will indeed be appointing a new Justice.  Something to think about.

Since there is no such medical procedure as a partial birth abortion, and only Intact dilation and extraction which is often used to remove a dead fetus from the womb, how’s that going to happen?

Guess the conservative packing of the Supreme Court is working.

That’s exactly what this ruling says. If you’re pregnant and that pregnancy endangers your health or your life, too bad. As a woman, you have NO right to live. You have NO right to do everything possible to save your life or protect your health. You are nothing.

Look at all the irrational left wing commentary on this–they have no problem with this horrific procedure, to destroy a child at 8 months is no problem to them.

it amazes me how intelligent some of you are. tell me, how is shoving a pair of scissors into the babys skull going to affect the health of the mother? its not! yes babies can be induced and born prematurely. and they can survive.
